On May 5, 2019, two prospective foster parents in South Carolina brought suit against the U.S. Department of Health and Human Services (HHS) and the Secretary of HHS; the Administration for Children and Families (ACF), the Assistant Secretary of ACF, and the Principal Deputy Assistant Secretary of ACF; the Governor of South Carolina; and the State Director of the South Carolina Department of Social Services. Plaintiffs alleged they had sought to serve as foster parents, but were turned away by Miracle Hill, a non-profit child-placing agency (CPA), when they identified themselves as a same-sex couple and members of the Unitarian Universalist Church. Plaintiffs alleged named defendants had permitted the organization, which receives federal funds, to maintain discriminatory policies in violation of state and federal laws such as federal 45 C.F.R. § 75.300(c).

Specifically, Miracle Hill required applicants to be affiliated with a Christian church, and did not accept married, same-sex couples as foster parents. After an investigation into Miracle Hill’s practices to determine if there were compliance issues with federal and state nondiscrimination requirements, the State Director of the South Carolina Department of Social Services issued a temporary CPA license to Miracle Hill, declining to reissue a standard CPA license and requiring a written plan of compliance to nondiscrimination law. Upon being made aware of the investigation, the South Carolina Governor asked the Principal Deputy Assistant Secretary of ACF for exemptions to nondiscrimination requirements to allow Miracle Hill to operate as is, and issued an Executive Order declaring faith-based CPAs should not be required to compromise sincerely held religious beliefs. HHS conditionally granted South Carolina an exemption to federal religious non-discrimination requirements which were set forth in 45 C.F.R. § 75.300(c) (2016). Thereafter, a standard CPA license was issued to Miracle Hill.

Plaintiffs alleged that (1) the state and federal defendants had violated the Establishment Clause of the U.S. Constitution by effectively authorizing the use of religious eligibility criteria for screening prospective foster parents; and (2) defendants had violated the Equal Protection Clause of the Fourteenth Amendment by discriminating against prospective foster parents on an impermissible basis. Plaintiffs sought declaratory and injunctive relief for their claims. 

The case was assigned to Judge Timothy M. Cain.

Defendants filed a motion to stay all proceedings until the resolution of what defendants believed was a related case: Madonna v. United States Dep't of Health and Human Servs. et al, 1988 U.S. Dist. LEXIS 12484. The court however declined to grant the motion, in part because it found the issues in the two cases were sufficiently different: Madonna involved only alleged religious discrimination, whereas this matter also involved same-sex discrimination.

The state defendants individually filed motions to dismiss and the federal defendants filed a joint motion to dismiss, largely asserting lack of standing, non-cognizable claims, and asserting that their actions did not discriminate or did so rationally in relation to legitimate government interests.

On May 8, 2020, the court issued an order, where it granted in part and denied in part federal defendants’ motion to dismiss. With respect to plaintiff’s Equal Protection Clause claims, the court held that defendants did establish the fact that there was discrimination, but that the appropriate review basis for that discrimination was rational scrutiny. The court held that the discrimination passed rational scrutiny analysis, and therefore plaintiffs’ equal protection claims fail as a matter of law and granted defendants’ motion to dismiss with respect to that. With respect to plaintiffs’ Establishment Clause claims, the court held that – taking plaintiffs’ assertions of fact as true – the claims did establish violations of the Establishment Clause, and that contrary to defendants’ claims in their motion to dismiss, defendants did not have immunity from such constitutional claims. As such, the court denied defendants’ motion to dismiss on these claims.

Thereafter, the federal defendants requested a protective order to limit discovery. Plaintiffs responded with a motion to compel discovery. On October 27, 2020, the court held that discovery disputes should largely be handled between the parties without judicial intervention. The parties continued to confer and on November 24, 2020, filed a joint status report indicating that they had largely resolved all outstanding discovery disputes and that document production efforts were ongoing, but requested more time (which was granted by the court) to determine the scope of discovery in light of plaintiffs’ pending motion for a protective order.

The case was reassigned to Judge Joseph Dawson, III. 

On January 19, 2021, the parties filed another joint status report, confirming they reached agreement on their discovery disputes and that plaintiffs would withdraw their motion to compel. On March 8, 2021, the court granted the federal defendants’ motion for a protective order, to prohibit discovery from those defendants beyond the limitations of the Administrative Procedure Act and require discovery be served only with leave of Court. Following privilege issues and continued discovery issues, plaintiffs filed a new motion to compel production of amended privilege logs, and defendants filed motions to stay discovery; the court denied the motion to stay.

The Governor and Director of the South Carolina Department of Social Services filed a motion for judgment on the pleadings, asking the court to find for defendants on the basis of Fulton v. City of Philadelphia, 141 S. Ct 1868 (2021) which was recently decided. On December 2, 2021, the court denied the motion. The court reasoned that the cases were differentiable, involving different claims, such that Fulton was not controlling precedent.

On January 7, 2022, federal defendants filed notice with the court that they had withdrawn the exception from the religious non-discrimination requirement in 45 C.F.R. § 75.300(c) that they had granted South Carolina.

On November 17, 2022, plaintiffs filed a motion for summary judgment against state defendants, arguing that the undisputed facts established that the defendants had unconstitutionally authorized and enabled CPAs to impose religious eligibility criteria to foster children. The state defendants filed a motion for summary judgment of their own on the same day, arguing in turn that their actions in providing religious accommodations were constitutionally permissible.

On November 16, 2022, the plaintiffs submitted a motion for voluntary dismissal of claims against federal defendants HHS, ACF, and the named defendants employed by those agencies. Plaintiffs noted that since the federal defendants had withdrawn the religious nondiscrimination exception that they had granted South Carolina, plaintiffs no longer wished to pursue the claims against those parties. On December 27, 2022, the court granted the motion to dismiss the claims against the federal defendants.

On September 29, 2023, the court denied plaintiffs’ motion for summary judgment against the state defendants, and instead granted the state defendants’ motion for summary judgment. With respect to the equal protection claims, the court found persuasive defendants’ argument that plaintiffs failed to identify a specific government action that they believe violates the Equal Protection Clause, and determined that plaintiffs failed to demonstrate that Miracle Hill is engaged in state action, a necessary pre-condition to hold the state defendants liable. The court therefore awarded summary judgment to the defendants on this matter. With respect to the Establishment Clause claims, the court held that to prevail, the plaintiff has the burden of proving a set of facts that historically would have been understood as an establishment of religion. The court held that plaintiffs failed to meet that burden here, because they did not set forth relevant facts that satisfy this historical analysis. Entering summary judgment for the defendants, the court dismissed the case in its entirety.

TEXT ORDER: Defendant Henry McMaster has filed a motion to stay the proceedings in this case. (ECF No. 32 ). The other Defendants have consented to this motion. (ECF Nos. 41, 42 ). McMaster and the other Defendants have also filed motions for extension of time to respond to the complaint to allow the court to rule on the motion to stay. (ECF Nos. 32, 33, 36 ).Defendant McMaster contends that the court should stay this action pending resolution of the motions to dismiss filed in a related case, Maddonna v. U.S. Dep't of Health & Human Servs., No. 6:19-cv-448-TMC (D.S.C. 2019). He contends that, because the two cases present similar factual and legal issues, a stay would simplify the issues, alleviate unnecessary hardship on Defendants caused by duplicative litigation, and impose no prejudice on Plaintiffs.In their response, Plaintiffs argue, inter alia, that a stay would not promote judicial economy because the issues in Madonna are different and that a stay would substantially prejudice Plaintiffs as they face barriers to their ability to foster a child and unduly delay their vindication of a constitutional right. Plaintiffs also argue that the motion to stay (and the motions for extensions) are untimely.Incidental to its power to control its docket, a district court has the inherent power to stay proceedings. Landis v. N. Am. Co., 299 U.S. 248, 25455 (1936). In deciding a motion to stay, a court should consider three factors, including: "(1) the interests of judicial economy; (2) hardship and inequity to the moving party if the action is not stayed; and (3) potential prejudice to the non-moving party." Murphy-Pittman v. DePuy Orthopaedics, Inc. No. 3:12-cv-3179-JFA, 2012 WL 6588697, *2 (D. S. C. Dec. 17, 2012) (citations omitted). First, the court finds that the motions to stay and for extension are not untimely as they were filed prior to the lapse of the time to respond to the complaint. See Rule 6(b)(1)(A) (providing that "[w]hen an act may or must be done within a specified time, the court may, for good cause, extend the time: (A) with or without motion or notice if the court acts, or if a request is made, before the original time or its extension expires"). Second, reviewing the allegations in the two cases, the court finds that the issues in Maddonna are different. Maddonnna involves only alleged religious discrimination and, here, there is the additional allegation regarding discrimination against a same sex couple. While there may be some issues which could overlap between the two cases, the issues are not the same, and this weighs against Defendants' argument that a stay is needed to avoid duplicative litigation. Moreover, a stay would arguably prejudice Plaintiff by delaying a resolution of this litigation. See Klaver Constr. Co., Inc. v. Kan. Dep't of Transp., No. 992510, 2001 WL 1000679, at *23 (D. Kan. Aug. 23, 2001) (recognizing a "plaintiff's interest in seeking vindication for alleged constitutional violations" and denying a request for a stay). Moreover, the fact that Plaintiffs seek injunctive relief against ongoing and future harm further counsels against a stay. See Lockyer v. Mirant Corp., 398 F.3d 1098, 1112 (9th Cir. 2005). Weighing these factors, the court finds that a stay is not warranted at this time. Accordingly, based on the foregoing, Defendants' motion for a Stay (ECF No. 32 ) is DENIED; and Defendants' Motions for Extensions (ECF Nos. 32, 33, 36 ) are GRANTED. TEXT ORDER: Pending before the court is Plaintiffs' motion to compel the State Defendants to fully respond to Plaintiff's First Sets of Requests for Production. (ECF No. 107 ). The Court is of the firm opinion that the attorneys involved in this action should be able to resolve the issues raised in this motion without intervention of the court and the expenditure of limited judicial resources, not to mention the additional expense to the parties should a hearing be necessary. Accordingly, the court directs the attorneys to redouble their efforts, in good faith, to reach a compromise on the matters raised in this motion and to file a joint status report as to their efforts by November 24, 2020. The report must indicate whether or not the parties have resolved the matters at issue in this motion. If the parties have failed to resolve the issues, the report must provide an explanation of the actions taken by each party to resolve the matter. The parties are given notice that, in the event a hearing and ruling by the court is necessary, the court reserves the right to assess sanctions, including fees and costs, against the non-prevailing party, and against any person or entity who fails to act in good faith to resolve the issues before the court.
