This lawsuit challenged an Idaho law that made it a crime for adults to help minors travel to other states for abortion care without their parents' knowledge and consent. 

On July 11, 2023, this case was brought in the United States District Court for the District of Idaho by an individual and two organizations, Northwest Abortion Access Fund (NWAAF) and Indigenous Idaho Alliance (IIA), that sought to assist Idaho minors in obtaining reproductive health care outside of Idaho. Plaintiffs brought this case against Raul Labrador, in his capacity as the Attorney General for the State of Idaho. Plaintiffs were represented by Legal Voice and The Lawyering Project. The case was assigned to U.S. Magistrate Judge Debora K. Grashamby. 

On July 11, 2023, Plaintiffs challenged as unconstitutional Idaho Code Section 18-623 (the “statute”), passed in 2020 which criminalized helping minors travel for abortion care, with intent to conceal the abortion from a parent or guardian. Plaintiffs sought a declaration that the statute was unconstitutionally void for vagueness, an infringement on the fundamental right to interstate travel, and an infringement on First Amendment rights. Plaintiffs claimed it was an infringement on First Amendment rights because the Constitution does not permit Idaho to bar providing information regarding conduct legal in another state just because it is illegal in one state; banning speech on the basis of a legal intended purpose is a violation of Plaintiff’s free speech rights. Plaintiffs also claimed it was an infringement on First Amendment rights because banning the use of funds on the basis of a legal intended purpose is also a violation of Plaintiffs’ free speech rights and it violated the free speech right to provide to pregnant persons in Idaho information regarding abortion access in states where it is legal. 

Plaintiffs also sought to enjoin Attorney General Labrador from enforcing the statute and sought reasonable attorneys’ fees and costs. 

On July 24, 2023, Plaintiffs filed a motion for a temporary restraining order or, in the alternative, a preliminary injunction enjoining the Attorney General from enforcing the statute. On November 8, 2023, the Court granted Plaintiff's motion. It held that Plaintiffs named the proper Defendant, demonstrated both subject matter jurisdiction and Article III justiciability, and established the requirements for a preliminary injunction. 

Also on November 8, 2023, the Court ruled on Defendant's pending motion to dismiss, granting it in part and denying it in part. The Court dismissed without prejudice the third claim for relief, which alleged that the statute unreasonably burdened, impermissibly restricted, and deterred Plaintiffs' right to intrastate travel and freedom of movement. The Court reasoned that Plaintiffs did not satisfy the threshold requirement of showing a liberty interest protected by the Constitution. As to the other claims, the Court found that Plaintiffs stated plausible claims that the statute violated their constitutional rights under the First and Fourteenth Amendments. The Court also found that the legislative materials quoted in the Complaint were evidence going to show that the statute was enacted for the purpose of prohibiting and deterring interstate travel and that Plaintiffs plausibly alleged that the statute facially impeded and deterred the right to interstate travel by unreasonably burdening their ability to enter and leave the state, and by criminalizing travel to another state with a pregnant minor to procure or obtain lawful abortion services.

On November 22, 2023, Defendant filed an appeal in the 9th Circuit as to the order on the motion to dismiss and on November 27, 2023, filed a motion to stay the injunction pending the appeal. 

On January 4, 2024, the Court denied Defendant's motion to stay the Court's preliminary injunction and stayed further proceedings in the case pending the appeal. The Court denied the motion to stay the Court’s preliminary injunction because the Court did not find irreparable harm and said that any harm that may occur to the Attorney General or State of Idaho is substantially outweighed by the harm caused to Plaintiffs were the preliminary injunction to be stayed. The Court justified staying further proceedings in the case pending the appeal by saying that where an interlocutory claim is immediately appealable, its filing divests the district court of jurisdiction to proceed with trial. 

On January 19, 2024, Defendant filed an emergency motion to stay the district court's order granting a preliminary injunction pending appeal in the 9th Circuit. On January 30, 2024, a 9th Circuit panel (Judges Kim McLane Wardlaw, Richard Paez, and Jacqueline Nguyen) denied Defendant's emergency motion. 

On May 7, 2024, the Ninth Circuit heard oral argument from the parties on the motion to dismiss.

As of August 31, 2024, the case is ongoing.
