This case concerns Yelp Inc.’s ability to publish truthful information about crisis pregnancy centers – businesses that offer pregnancy-related counseling but not abortion services or referrals to abortion providers. 

Beginning in August 2022, Yelp, Inc. (“Yelp”) published a notice informing users that crisis pregnancy centers “typically provide limited medical services and may not have licensed medical professionals onsite.” In February 2023, Ken Paxton, the Attorney General of Texas, signed a letter demanding Yelp remove the notice. Yelp updated the notice to state that “Crisis Pregnancy Centers do not offer abortions or referrals to abortion providers.” 

On September 22, 2023, Attorney General Paxton provided Yelp with a notice of intent to file suit within seven days. On September 27, 2023, Yelp filed a preemptive lawsuit against Attorney General Paxton, alleging that the Attorney General’s actions violated the First Amendment. The company brought the lawsuit in the U.S. District Court in the Northern District of California, and it sought declaratory judgment, preliminary and permanent injunctive relief, and attorneys' fees.

On September 28, 2023, the case was assigned to Magistrate Judge Sallie Kim. However, either because a party did not consent to a Magistrate Judge’s jurisdiction or because of a timing issue, the case was reassigned the same day to U.S. District Court Judge Trina L. Thompson. 

The same day, September 28, 2023, Attorney General Paxton sued Yelp in the Bastrop County District Court in Texas. The State alleged that, by publishing the original notice, Yelp engaged in false, misleading, or deceptive acts or practices in violation of the Texas Deceptive Trade Act. The State sought monetary relief, including penalties and attorneys fees, and injunctive relief. 

In the lawsuit brought by Yelp, Attorney General Paxton filed a motion to dismiss on October 16, 2023; a hearing on the Motion is set for February 20, 2024. As of November 17th, 2023, Yelp's motion for a preliminary injunction was pending before the court.
