This case challenges Glynn County, Georgia's cash bail system.

Two named plaintiffs, incarcerated persons accused of misdemeanors who could not afford to pay bail or hire a private attorney, filed suit against Glynn County in the U.S. District Court for the Southern District of Georgia on March 9, 2018. Represented by the American Civil Liberties Union, plaintiffs filed suit against the sheriff, magistrate judge, and the public defender for misdemeanors for Glynn County. The plaintiffs alleged that there was a two-tiered detention practice administered by the defendants because the release of detainees was determined by their access to money and not their flight risk. This lawsuit was brought under 42 U.S.C. § 1983. The plaintiffs alleged the defendants’ actions violated the Fourteenth Amendment and that in detaining misdemeanor arrestees without an individualized, adversarial hearing and requisite factual findings, the defendants violated the Fourteenth Amendment. Additionally, they alleged that the defendant violated indigent misdemeanor arrestees' Sixth Amendment right to counsel and equal protection in the provision of counsel because Glynn County’s public defender did not visit indigent clients or file motions to reduce their bail. On the same day, the plaintiffs sought a preliminary and permanent injunction to prevent the County from continuing to jail them solely because they were unable to pay their bail amounts, a temporary restraining order, and monetary damages.

The plaintiffs also filed a motion to certify two classes on March 9, 2018. The first was a bail class composed of misdemeanor arrestees in Glynn County who have been or will be detained because they are unable to pay the amount of bail required for their release. The second class was a counsel class of all arrestees charged with a misdemeanor in Glynn County whose maximum income is 100 percent of the federal poverty guidelines or less and who otherwise qualify for a public defender.

The case was assigned to District Judge R. Stan Baker and Magistrate Judge Benjamin W. Cheesbro.

On May 9, 2018, the defendants filed a motion to dismiss. Details of the motion were not available to the Clearinghouse.

A settlement conference was held on December 6, 2018. The parties ultimately reached a settlement agreement, and the case was dismissed on July 8, 2019. The settlement agreement was for the following reforms: bail hearings being held at least four times per week with none more than 48 hours apart; prompt judicial evaluations of bail amounts using an improved financial hardship/indigency affidavit and considering what amount of money the person who is arrested is currently able to pay; improved notice to arrestees of issues relating to bail determinations, including the ability to seek reconsideration of bail determinations and information about future court appearances, as well as contact information for the public defender; and a term of independent monitoring to ensure continued implementation of the agreed changes to the bail determination system.

The case is now closed.
