This is a case about allegations of inadequate mental health services in Iowa. On January 6, 2023, the plaintiffs filed this class-action lawsuit in the United States District Court for the Southern District of Iowa, seeking to represent "all Medicaid-eligible children in the State of Iowa under the age of twenty-one who (a) have a serious emotional disturbance, not attributable to an intellectual or developmental disability, and (b) for whom a licensed practitioner of the healing arts has recommended intensive home and community-based services to correct or ameliorate their conditions." The plaintiffs brought claims against the Iowa Department of Health and Human Services (IDHHS) under 42 U.S.C. § 1983, the Americans with Disabilities Act (ADA), and Section 504 of the Rehabilitation Act. Represented by Children’s Rights, Disability Rights Iowa, National Health Law Program, and private counsel, the plaintiffs sought declaratory and injunctive relief and attorneys’ fees and costs.

The plaintiffs claimed that the IDHHS failed to meet statutory requirements under three main statutes: (1) the Early and Periodic Screening, Diagnostic, and Treatment (EPSDT) Services provision of the Medicaid Act; (2) the Americans with Disabilities Act; and (3) the Rehabilitation Act. The plaintiffs asserted that the IDHHS did not provide essential mental and behavioral health services (or arrange for them to be provided) with "reasonable promptness," as required by the Medicaid Act, and did not provide services "in the most integrated setting appropriate to [the plaintiffs'] needs," as required by the ADA and Rehabilitation Act. They alleged that the IDHHS violated these statutes by not providing sufficient home and community-based services.

This case was assigned to U.S. District Judge Stephen H. Locher. 

On February 13, 2023, the IDHHS filed a motion to dismiss for failure to state a claim. On May 15, 2023, the court denied the motion to dismiss. First, the court held that the plaintiffs had stated a Medicaid Act claim because the IDHHS was obligated to make EPSDT services available. Though the IDHHS had offered to pay for the services, that was insufficient if they were unavailable. Second, the court rejected the IDHHS's argument that a screening did not entitle someone to treatment unless they requested the screening from IDHHS. Third, the court held that the delays alleged by the plaintiffs qualified as violations of the Medicaid Act's "reasonable promptness" requirement. Finally, the court held that the statute of limitations was inapplicable because the plaintiffs sought injunctive relief, and alleged ongoing violations. 673 F.Supp.3d 967.

On June 27, 2023, the IDHHS filed a joint motion for a settlement conference and to stay proceedings. After a telephonic status conference on June 29, 2023, the motion was granted in part, with the deadlines in the case stayed until September 27, 2023, to allow the parties time to pursue settlement discussions. Settlement conferences were held on August 11, 2023 and September 15, 2023.

On October 2, 2023, the parties announced that they had reached a preliminary settlement. The IDHHS agreed to change its services based on the issues the plaintiffs had raised, including providing better home and community services, making screening procedures more consistent, and heightening oversight. The parties filed a joint motion to approve an interim settlement, certify the class, extend the stay of litigation and amend the scheduling order.

The order was granted on October 12, 2023, with the October 15, 2024 trial canceled. The class was certified as "all Medicaid-eligible children in the State of Iowa under the age of twenty-one, (i) who have been determined by a licensed practitioner of the healing arts as having a serious emotional disturbance, not attributable to an intellectual or developmental disability, and (ii) for whom there is an assessment that intensive home and community-based services are needed to correct or ameliorate their condition.”

As of October 20, 2023, the case is ongoing, with all formal discovery stayed until July 1, 2024.
