Plaintiffs alleged that allowing transgender students to use gender-affirming restrooms, locker rooms and shower facilities violated her state and federal constitutional right to bodily …

This case concerns whether the accommodations of transgender students in Maryland constitute a violation of a cisgender student's rights. 

On August 11, 2017 a cisgender Maryland student and her parents filed suit against the Board of Education of Frederick County, Maryland in Maryland's Federal District Court. Plaintiffs alleged that allowing transgender students to use gender-affirming restrooms, locker rooms and shower facilities violated her state and federal constitutional right to bodily privacy, free speech and parental liberty, violated Title IX and violated several state educational statutes. Plaintiffs also alleged a violation of the state constitution's separation of powers on account of the school district instituting policies which plaintiffs alleged changed "the centuries-old laws and customs of the people" and therefore should have been done by a legislative body. Plaintiffs sought declaratory and injunctive relief. Plaintiffs were represented by private counsel. The case was assigned to Judge Ellen Hollander. 

The case was voluntarily dismissed by plaintiffs on November 6, 2017.
