This lawsuit was filed September 23, 2014, in the United States District Court for the District of Columbia against the United States Department of Defense, the Secretary of Defense, the United States Army, and other named officials. Plaintiff is a transgender woman who was serving a 35-year sentence at the United States Disciplinary Barracks at Fort Leavenworth, Kansas. Plaintiff had been previously diagnosed with gender dysphoria and alleged that defendants denied her medically necessary treatment in violation of the Eighth Amendment's ban on cruel and unusual punishment. Represented by the ACLU of Washington D.C., Plaintiff sought declaratory and injunctive relief and attorneys’ fees. Judge Colleen Kollar-Kotelly presided.

On the same day she filed her complaint, plaintiff filed a motion for preliminary injunction, seeking to require defendants to provide her medical treatment in accordance with standards established by the World Professional Association for Transgender Health. This treatment included: (1) the provision of hormone therapy for her gender dysphoria, (2) permission to follow female grooming standards, and (3) access to treatment by a medical provider qualified to treat her condition.

The parties filed a joint status report in March 2015, which indicated that since the complaint was filed, plaintiff’s treatment plan had changed. She was now receiving weekly psychotherapy, was provided female undergarments, had the ability to wear certain prescribed cosmetics, and was receiving hormone therapy. However, plaintiff still disputed certain issues, including (1) the adequacy of her treatment plan as a whole, (2) defendant’s failure to allow her to grow her hair longer, and (3) the qualifications of her psychologist with respect to gender dysphoria. Since the parties disagreed on whether the case was moot, they requested the court to stay the proceedings for seven months. The court granted the stay and directed the parties to file a joint report no later than September 28, 2015.

On September 28, 2015, the parties filed a joint status report in which Plaintiff withdrew her motion for a preliminary injunction. The following month, on October 5, Plaintiff filed an amended complaint against all defendants, reasserting her Eighth Amendment claim and adding a new claim for sex discrimination in violation of the equal protection component of the Fifth Amendment's Due Process Clause. Plaintiff alleged that Defendants did not allow her to follow the hair length and grooming standards applied to other incarcerated women, which constituted discrimination based on her transgender identity.

Defendants filed a motion to dismiss on November 12, 2015. The parties filed a joint status report in December 2016, and in January 2017, plaintiff filed a consent motion to stay proceedings. She stated that earlier that month, President Obama had commuted her sentence, and pursuant to the order, she would be released from custody on May 17, 2017. As such, she indicated that the matter would become moot on that date. The court granted the motion, and proceedings were stayed until May 2017.

On May 22, 2017, plaintiff filed a stipulation of dismissal indicating that she was voluntarily dismissing the action against all defendants without prejudice. The court dismissed the case the same day, and it is now closed.
