This case is a constitutional challenge to Kansas laws which prohibited same-sex marriages.

On October 10, 2024, two same-sex couples who reside in Kansas sued the Secretary of the Kansas Department of Health and Environment, a Clerk of the District Court for the 7th Judicial District, and a Clerk of the District Court for the 18th Judicial District, in U.S. District Court for the District of Kansas, Kansas City Division. Plaintiffs challenged the state of Kansas’ practice of denying marriage status to same-sex couples. Several Kansas laws codified today in Chapter 23, Article 25 of the Kansas Statutes Annotated, dating back to 1980, bar same-sex marriage, and the Kansas Constitution was amended in 2005 to declare that same-sex marriages are contrary to the public policy of the state and are void. 

In their complaint, plaintiffs alleged the following facts: One of the plaintiff couples had attempted to apply for a marriage license at the Clerk of the Douglas County District Court on October 8, 2014, but on October 9, the Chief Judge of the Seventh Judicial District issued an administrative order, declaring that the Clerk of the District Court shall not issue marriage licenses to same-sex couples. The other plaintiff couple had also attempted to apply for a marriage license at the Clerk of the District Court for the 18th Judicial District, but similarly were informed that the District Court Clerk for the 18th Circuit would not issue same-sex marriage licenses.

Plaintiffs made the following claims for relief: (1) Kansas law which precludes marriage for same-sex couples or otherwise prevents their recognition violates the due process guarantee of the Fourteenth Amendment of the U.S. Constitution, by depriving plaintiffs of a fundamental liberty interest without a legitimate government interest or tailoring. (2) Kansas law as to same-sex marriage also violates the Equal Protection Clause of the Fourteenth Amendment, by discriminating on the basis of sexual orientation. Plaintiff sought declaratory and injunctive relief, to require defendants to permit issuance of marriage licenses to same-sex couples to marry. Plaintiffs also filed a motion for preliminary injunction and a temporary restraining order, requesting the same.

The matter was assigned to District Judge Daniel D. Crabtree and Magistrate Teresa J. James.

On October 22, 2014, two private individuals, an opposite-sex married couple in Kansas, filed a motion to intervene as interested parties, arguing that they had a property right in their marital status which the pending case here could potentially affect. Two days later, the court denied the request, finding that the individuals had neither an intervention of right as they failed to demonstrate they were not adequately represented by the parties in the litigation nor would permissive intervention be appropriate. Similarly, the Westboro Baptist Church sought to intervene as an interested party, on similar grounds, which the court denied in November 2014.

On November 4, 2014, the court granted the plaintiffs’ motion for preliminary injunctive relief. The court noted that the Tenth Circuit had held that the Fourteenth Amendment enshrines the fundamental right to marry, establish a family, raise children, and enjoy the full protection of a state’s marital laws – and that a state may not deny issuance of a marriage license based solely on sex. The court concluded that Kansas’s same-sex marriage ban directly contravened the Fourteenth Amendment, as interpreted by the Tenth Circuit. Finding therefore that states cannot constitutionally prohibit same-sex marriages, the court granted the preliminary injunction, therefore enjoining defendants from continued enforcement of application of Kansas law and state constitutional provisions which prohibited the issuance of marriage licenses to same-sex couples. Defendants requested a temporary stay of the preliminary injunction to file an appeal, which the court granted. The court lastly denied plaintiffs’ motion for a temporary restraining order as moot.

On November 5, 2014, defendants filed their appeal with the Tenth Circuit Court of Appeals (docket no. 14-3246).

On November 10, 2014, the U.S. Supreme Court, upon receiving an application for stay, initially ordered the preliminary injunction that the district court had entered be stayed while it considered a decision in another case (docket no. 14-556), but on November 12, denied the application, therefore vacating the order.

On November 26, 2014, plaintiffs filed an amended complaint against all defendants. In the amended complaint, additional plaintiffs and defendants were added, and the plaintiffs asserted a new claim for marriage recognition. Following the entry of the amended complaint, the Westboro Baptist Church filed a renewed motion to intervene. On December 8, 2014, plaintiffs filed a motion for preliminary injunction on their marriage recognition claims. On December 10, defendants filed a motion to dismiss.

On December 18, 2014, the court again denied the request of the Westboro Baptist Church to intervene. The court held that as plaintiffs here only seek the right to marry with state recognition, their claims only affect marriage in the civil realm, not the religious one – therefore, the Westboro Baptist Church’s expertise litigating their religious rights did not have bearing on this case. After the court’s ruling, the Westboro Baptist Church filed a notice of appeal.

On January 20, 2015, defendants filed a new motion to dismiss for failure to state a claim and/or lack of subject matter jurisdiction. On February 13, 2015, plaintiffs filed a motion for summary judgment.

The U.S. Supreme Court decided to hear a consolidated appeal, arising from similar challenges to same-sex marriage laws in other states that had resulted in a circuit split between the Sixth and Tenth Circuit on the constitutionality of recognizing same-sex marriages. On June 26, 2015, the Supreme Court decided Obergefell v. Hodges, 576 U.S. 644 (2015) (docket no. 14-556), holding that laws banning same-sex marriage violate due process and equal protection rights guaranteed in the U.S. Constitution.  On July 9, 2015, defendants filed a motion to dismiss, arguing that Kansas government officials have complied with Obergfell, and that plaintiffs’ claims were therefore moot.

On August 10, 2015, the court issued its order. Examining the connection of Obergefell to this case, the court held that the Kansas ban against same-sex marriage violates due process and equal protection rights granted in the U.S. Constitution. With respect to defendants’ arguments that they had already come into compliance, therefore meaning that the claims in the case could be denied for mootness, the court held that the defendants were nominally in compliance due to the preliminary injunction which had been granted in the case, but that defendants failed to demonstrate that absent the injunction the allegedly wrongful behavior could not be expected to recur. Therefore, the court declared that the defendants’ conduct violate the Fourteenth Amendment to the U.S. Constitution. However, as defendants had made remedial commitments to comply with Obergefell, the court held it appropriate to defer the permanent injunction for some interim time, so the parties could supplement the record and enable the court to better decide if issuance of a permanent injunction is appropriate. The parties did so, and on July 22, 2016, the court issued a memorandum and order, granting plaintiffs’ request for permanent injunction. In granting the request, the court held that while defendants had taken steps to comply with the rule of constitutional law that Obergefell established, defendants failed to show the requisite reliability that the doctrine of prudential mootness required, making permanent injunctive relief necessary. The court further noted that following this ruling, the only outstanding claim that plaintiffs had in the case was their request for attorney’s fees and costs.

On August 12, 2016, the U.S. Court of Appeals for the Tenth Circuit granted the appellee’s motion to dismiss their appeal as moot, dismissing the appeal.

The parties filed a joint motion to alter the judgment entered by the court to dissolve the injunction and stipulate to dismissal with prejudice with respect to two defendants.

On September 27, 2016, the court granted the motion and, pursuant to the parties’ request, modified its judgment. The court therefore ordered that pursuant to the parties’ stipulation, two defendants were dismissed from the case with prejudice, and plaintiffs’ conditionally unopposed motion for attorney’s fees, taxable cost, and litigation expenses in the amount of $295,000 be granted. The court also issued an amended judgment the same day to grant plaintiffs judgment against defendants, ordering that Kansas law and constitutional provisions which forbid same-sex marriage licenses and same-sex marriage recognition generally are void, and enjoining defendants from enforcement of those null laws or otherwise treating same-sex married coupled differently from opposite-sex couples in processing marriage licenses or otherwise administering marriage-related benefits.
