This case is about the Pima County Recorder’s failure to re-establish an in-person early voting location on the Pascua Yaqui Pueblo Reservation ahead of the 2020 general election. On October 12, 2020, the Pascua Yaqui Tribe filed this lawsuit in the U.S. District Court for the District of Arizona (Tucson). The Tribe sued the Pima County Recorder under Section 2 of the Voting Rights Act, 52 U.S.C. § 10301, and 42 U.S.C. § 1983. The Tribe alleged that refusing to reinstate an early voting site on the reservation, particularly in light of the COVID-19 pandemic, placed a disparate burden on Native American voters, in violation of the Voting Rights Act and the First and Fourteenth Amendments to the U.S. Constitution.

Represented by the Campaign Legal Center, the Tribe sought 1) a declaratory judgment that the County Recorder violated the First and Fourteenth Amendments, as well as Section 2 of the Voting Rights Act; 2) an injunction ordering the reestablishment of an early voting site and ballot drop-off location within the reservation; and 3) attorneys’ fees. The case was assigned to District Judge James A. Soto.

On October 13, 2020, the Tribe filed an emergency motion for a preliminary injunction that would require the Pima County Recorder to reestablish and operate an early voting site on the reservation by October 26, 2020. The court ordered an expedited briefing schedule and an evidentiary hearing that took place on October 19 and 20. On October 22, 2020, the court denied the motion because it found the Tribe had not met its burden of showing irreparable harm and that setting up a last-minute early voting location would hamper the Recorder’s ability to properly administer the election.

On July 7, 2021, following the U.S. Supreme Court’s decision regarding the Voting Rights Act in Brnovich v. Democratic National Committee, 594 U.S. 647 (2021), the district court dismissed the Tribe’s complaint with leave to file an amended complaint that would incorporate the new guidance from the Supreme Court. The district court also ordered the parties to file a joint status report by August 13, 2021, regarding whether litigation was still required in this case. On August 12, the parties reached a settlement in which the Recorder agreed to establish an early voting location on the reservation for every statewide primary and general election through 2024.

On August 13, 2021, the court dismissed the complaint without prejudice.
