EO: The parties filed a 65 Joint Motion to Set Stipulated Briefing Schedule, identifying the relevant legal issues and proposing a briefing and hearing schedule for the motions for summary judgment that are expected to resolve this litigation. Given the issues to be litigated, the Court finds that judicial economy will be served by a multistep process. The parties dispute Plaintiffs' standing, a threshold issue concerning subject matter jurisdiction. Therefore, it should be addressed as a preliminary matter, particularly because the Court may "allow or [] require the plaintiff to supply, by amendment to the complaint or by affidavits, further particularized allegations of fact deemed supportive of plaintiff's standing." Maya v. Centex Corp., 658 F.3d 1060, 1067 (9th Cir. 2011) (citation and quotations omitted). Once the motion(s) regarding standing are filed, the Court will set the briefing schedule.
