This case alleged that the process implemented by the Illinois Secretary of State and the Illinois Board of Elections (the “Board”) for offering voter registration during certain transactions related to driver’s licenses frustrated Illinois citizens’ ability to register to vote in violation of the National Voter Registration Act, Voting Rights Act, and Illinois’ Automatic Voter Registration statute.  

On February 28, 2020, various non-profit organizations filed this lawsuit in the U.S. District Court for the District of Illinois, against the Illinois Secretary of State and the Illinois Board of Elections.  Plaintiffs alleged that the process implemented by Defendants for offering voter registrations during certain transactions related to driver’s licenses frustrated Illinois citizens’ ability to register to vote.  Plaintiffs alleged Defendants violated the National Voter Registration Act for allegedly: (i) failing to provide voter registration to recently naturalized citizens; (ii) failing to provide required information to applicants; (iii) failing to automatically update voter files with address changes; and (iv) requesting duplicative information for non-REAL ID transactions. Plaintiffs also alleged that Defendants violated the Voting Rights Act and the Illinois Automatic Voter Registration statute. The case was ultimately assigned to District Judge Charles R. Norgle, Sr. and Magistrate Judge Jeffrey I. Cummings.

On June 24, 2020, Defendant Illinois Secretary of State filed a partial motion to dismiss Plaintiffs’ state-law claims alleging violations of the Illinois Automatic Voter Registration statute on the basis that the claims were barred by the Eleventh Amendment.  

On July 1, 2020, Defendant Board moved to dismiss Plaintiffs’ complaint on the basis that (i) Plaintiffs failed to make specific allegations against the Board; (ii) Plaintiffs lacked standing because they had not alleged any injury traceable to the Board; and (iii) the Eleventh Amendment barred Plaintiffs’ claims for violations of the Automatic Voter Registration.  Plaintiffs filed an opposition on October 26, 2020, and the Board filed a reply on November 17, 2020.

On March 25, 2021, the Court granted Defendants’ motions to dismiss, holding that Plaintiffs failed to allege any injury fairly traceable to any conduct by the Board and that Plaintiffs’ state-law claims were barred by the Eleventh Amendment. Plaintiffs' federal claims under the Voter Registration Act and the Voting Rights Act against the Illinois Secretary of State remained, as the Secretary had not moved to dismiss and instead answered those claims.

On June 28, 2021, Plaintiffs and Defendant Illinois Secretary of State jointly stipulated to dismissal of all claims in the action with prejudice, notifying the court that they amicably resolved their differences pursuant to a private Settlement Agreement dated June 24, 2021. Each party agreed to bear its own costs and attorneys' fees.  

This case is now closed.
