This is a case about a voter's right to vote by mail.
On September 8, 2020, an individual who wanted to vote via mail-in ballot filed suit in the United States District Court for the Northern District of Illinois and alleged that the Postmaster General of the United States Parcel Service, the Chairman of the Postal Service Board of Governors, and the United States Parcel Service violated Plaintiff’s right to vote by unlawfully consolidating post offices in violation of 39 U.S.C. § 404. Specifically, Plaintiff alleged that herself and similarly situated people had their right to vote infringed on because Defendants removed delivery bar code sorting machines from various post office locations around Chicago without providing at least 60 days’ notice, as required by 39 U.S.C. § 404, of such consolidation. The case was assigned to the Honorable Marvin E. Aspen.
On November 11, 2020, Plaintiff filed a Notice of Voluntary Dismissal Without Prejudice. This notice was served before Defendants served an answer to Plaintiff’s complaint or filed a motion for summary judgment. The reasons for the dismissal are unknown to the Clearinghouse at this time.
On November 23, 2020, the case was dismissed without prejudice and each party was ordered to bear its own costs and fees.
