On September 7, 2021, various non-profit and civil rights organizations and a statewide labor union filed this lawsuit in the United States District Court for the Western District of Texas against the Texas Deputy Secretary of State, Texas Attorney General, and various Texas County Elections Administrators. Plaintiffs alleged that Texas’ Senate Bill 1 (“SB 1”) was an omnibus voter suppression bill that unlawfully burdened voters, restricted access to the vote, and targeted the very measures that communities of color disproportionately relied on to increase voter turnout in the 2020 election. Specifically, Plaintiffs challenged SB 1’s provisions (the “Suppressive Provisions”) that: (i) criminalized efforts by public officials to encourage voters to submit absentee ballot applications; (ii) imposed additional burdens on absentee voters by effectively eliminating ballot drop boxes; (iii) eliminated drive-thru voting; (iv) created additional obstacles for voters to receive assistance at the polls or in completing and submitting absentee ballots; (v) limited early voting hours; and (vi) empowered partisan poll watchers to employ voter intimidation tactics. The Suppressive Provisions, Plaintiffs alleged, violated the First and Fourteenth Amendments to the U.S. Constitution and the Voting Rights Act of 1965. Represented by private counsel, Plaintiffs sought declaratory relief and requested that the Court enjoin Defendants from implementing the Suppressive Provisions.  This case was assigned to the Honorable Xavier Rodriguez.

On September 30, 2021, the Court consolidated this case with La Unión del Pueblo Entero v. Abbott, No. 5:21-cv-844 (W.D. Tex.), and was closed.
