On December 30, 2021, the American Civil Liberties Union (ACLU), the ACLU of Georgia, and WilmerHale filed a lawsuit against the Georgia Secretary of State in the U.S. District Court for the Northern District of Georgia on behalf of Alpha Phi Alpha Fraternity, Inc., the Sixth District of the African Methodist Episcopal Church, and several individual Georgia voters. The Plaintiffs alleged that the newly drawn legislative maps for Georgia’s General Assembly diluted the voting power of Black Georgians by failing “to include more than a half-dozen additional districts where Black voters could form a majority and . . . elect candidates of choice,” in violation of Section 2 of the Voting Rights Act of 1965 (VRA). Plaintiffs sought declaratory and injunctive relief, as well as attorneys’ fees. The case was assigned to District Judge Steve C. Jones.

Plaintiffs filed a motion for preliminary injunction on January 7, 2022, seeking to enjoin the Georgia Secretary of State from holding 2022 elections using the redistricting plans that were adopted during the 2021 Georgia legislative session.

On January 14, 2022, the State filed a motion to dismiss for lack of subject matter jurisdiction and failure to state a claim. They argued that the Court lacked subject matter jurisdiction over Plaintiffs’ claims because Plaintiffs failed to request a three-judge Court and, even if the Court had subject matter jurisdiction, Plaintiffs did not have a private right of action under Section 2 of the VRA. The State also requested that, if the motion were to be denied, the Court certify the order for immediate review by the Eleventh Circuit Court of Appeals. On January 28, 2022, the Court denied Defendant’s motion to dismiss and their request for certification for an immediate appeal. The Court held that: (i) a three-judge Court is not required to hear purely statutory challenges to the apportionment of a Statewide legislative body; (ii) private individuals may bring claims under Section 2 of the VRA; and (iii) an immediate appeal was not authorized under the facts of the case. 2022 WL 20690354.

Subsequently, on February 28, 2022, the Court denied Plaintiffs’ motion for preliminary injunctive relief. The Court held that, although Plaintiffs met their burden of establishing that the State’s redistricting plans were unlawful and that voting under these plans would result in irreparable harm, the balance of equities ultimately weighed against injunctive relief. The Court reasoned that it was not in the public interest to block the use of the enacted redistricting maps and disrupt the 2022 election process, which was already underway.

The State filed a motion for summary judgment on March 20, 2023, which was denied on July 17, 2023. 2023 WL 5674599.

Following an eight-day bench trial in September 2023, the Court held, on October 26, 2023, that Georgia’s congressional and legislative maps unlawfully diluted the voting strength of Black Georgians in multiple parts of the State in violation of Section 2 of the VRA and enjoined the State from using the enacted maps in future elections. The Court issued a permanent injunction and ordered Georgia to enact new maps by December 8, 2023. 700 F.Supp.3d 1136.

The State appealed the ruling to the U.S. Court of Appeals for the Eleventh Circuit on November 28, 2023, and simultaneously proceeded to comply with the Court’s directive to redraw the maps. In response, Plaintiffs filed an objection and a motion for leave to file brief as amici curiae in opposition to the State’s proposed remedial maps on December 12, 2023, arguing that the new maps failed to remedy the areas the Court had found to be experiencing vote dilution. Plaintiffs requested that the Court reject the proposed maps and order the adoption of lawful remedial plans that would actually cure the violations and “advance the work of building an equal political process in Georgia.”

On December 28, 2023, the Court overruled Plaintiffs’ objections, reasoning that Georgia’s proposed remedial maps fully complied with the Court’s order and properly addressed Plaintiffs’ injuries. 2023 WL 9424682.

On May 3, 2024, the U.S. Court of Appeals for the Eleventh Circuit granted Plaintiffs’ motion for leave.  

As of March 2026, the parties have presented oral argument, and the case remains pending before the U.S. Court of Appeals for the Eleventh Circuit. Related cases include Annie Grant, et al. v. Secretary of State of Georgia and Coakley Pendergrass, et al. v. Secretary of State of Georgia.
