This is a fast-paced case about redistricting and the drawing of congressional maps in the Commonwealth of Pennsylvania following the results of the decennial census in which Pennsylvania lost one congressional seat.

The case was filed in the Middle District of Pennsylvania on February 10, 2022, one day after the Supreme Court of Pennsylvania announced that it was suspending the General Primary Election calendar codified in 25 Pa. Stat. §§ 2868 and 2873.  Bringing the case were four registered voters in Pennsylvania, including a Republican candidate for Congress and a member of the Susquehanna County Board of Elections at the time of filing. At the request of plaintiffs, the case was assigned to a three-judge panel under 28 U.S.C. § 2284(a) since it challenged the constitutionality of the apportionment of congressional districts. Represented by private counsel, plaintiffs brought suit under 42 U.S.C. § 1983 and the Declaratory Judgment Act, naming three Pennsylvania government officials as defendants, including the Acting Secretary of the Commonwealth, the Director for the Pennsylvania Bureau of Election Services and Notaries, and the Governor of Pennsylvania. Plaintiffs claimed these state officials, by failing to enact a new congressional map in time for the 2022 elections and instead investing the state supreme court with that responsibility, usurped the authority that the Elections Clause of the United States Constitution assigns to the state legislature, as the Elections Clause gives “the Legislature” and not the judiciary the power to “prescribe” the manner of electing representatives. Plaintiffs sought declaratory and injunctive relief in order to compel the defendants to hold at-large elections for the 2022 Pennsylvania congressional delegation, notwithstanding any ruling that might issue from the Supreme Court of Pennsylvania, unless and until the General Assembly enacted a new congressional map.

Following Pennsylvania's loss of one Congressional seat as a result of the decennial census, the state legislature was required to draw a new congressional map for the 2022 elections. Although the General Assembly passed a new congressional map in early 2022, it was vetoed by Governor Wolf. In the meantime, a separate group of litigants requested the Supreme Court of Pennsylvania to impose a congressional map for the 2022 elections and that Court scheduled oral arguments on the matter to be held on February 18, 2022, 8 days after the filing of this complaint in the Middle District of Pennsylvania. In their complaint, plaintiffs claimed that any map imposed by the state supreme court would be unconstitutional and that the General Assembly had not authorized the state judiciary to draw congressional maps or participate in the redistricting process in any way. 

On February 20, 2022, just days after the oral argument at the state supreme court, plaintiffs filed an amended complaint, adding one more plaintiff who was a registered voter in Pennsylvania and a Republican candidate for Congress. On the same day, plaintiffs filed an emergency motion for temporary restraining order and preliminary injunction. The motion challenged as unconstitutional the February 9, 2022 sua sponte order of the Supreme Court of Pennsylvania in which it announced it was “suspending” the General Primary Election calendar as well as the Court's efforts to impose a court-drawn congressional map. Plaintiffs claimed it was too late for the Supreme Court of Pennsylvania to draw a congressional map for the 2022 elections without disrupting the election process and cutting into the three-week period that the legislature had provided for obtaining the needed signatures to appear on the ballot. The motion requested that the suspension of the legislatively prescribed calendar be rectified as soon as possible.

On February 22, 2022, the litigants who had filed the relevant petition in the state supreme court filed a motion to intervene in this case (the "Carter Intervenors").

On February 23, 2022, plaintiffs filed a renewed emergency motion for temporary restraining order.

On February 25, 2022, district court Judge Jennifer Wilson issued an order denying plaintiffs' motions for temporary restraining order. Judge Wilson stated the court would not grant a temporary restraining order
on the expedited basis requested by plaintiffs prior to resolving the jurisdictional issues raised by defendants and the potential intervenors. She set a briefing schedule for a motion to dismiss on jurisdictional issues and noted it was appropriate for the court to make this ruling prior to resolving the request to convene a three-judge district court panel pursuant to 28 U.S.C. § 2284(b)(3).

On February 27, 2022, plaintiffs filed a second amended complaint, adding another registered voter in Pennsylvania as a plaintiff.

On February 28, 2022, plaintiffs filed an interlocutory appeal of the February 25th order with Justice Alito of the United States Supreme Court. On the same day, Judge Wilson granted the motion to intervene. Toth v. Chapman, No. 1:22-CV-00208, 2022 U.S. Dist. LEXIS 245148 (M.D. Pa. Feb. 8, 2022).

On March 1, 2022, defendants filed their motion to dismiss for lack of jurisdiction.

On March 3, 2022 Judge Wilson issued an order convening a three-judge district court pursuant to 28 U.S.C. § 2284(b)(3) to hear the case.

On March 7, 2022, the application for writ of injunction presented to the U.S. Supreme Court was denied. 142 S. Ct. 142 (2022).

On March 9, 2023, the Carter Intervenors filed a Notice of Supplemental Authority, informing the district court panel of the Pennsylvania Supreme Court’s majority opinion in Carter v. Chapman, 270 A.3d 444 (Pa. 2022). In this opinion the state supreme court sided with the position of the Carter Intervenors, adopting the Carter Plan for the Pennsylvania primary and general elections for seats in the United States House of Representatives commencing in 2022 ("2022 Congressional Redistricting Plan").

On March 10, 2023, plaintiffs filed a Notice to the Court Withdrawing Emergency Motion for Temporary Restraining Order and Preliminary Injunction, informing the court of Justice Kavanaugh's concurring opinion in Moore v. Harper, 142 S. Ct. 1089 (2022), in which the U.S. Supreme Court denied emergency relief in a case very similar to that brought by plaintiffs. Plaintiffs noted that Justice Kavanaugh’s concurrence in Moore indicated that emergency relief from the district court enjoining the implementation of the Carter Plan for the 2022 elections would be improper under the Purcell Doctrine, and would likely be reversed by the U.S. Supreme Court. Plaintiffs thus asked to withdraw the emergency motion for injunctive relief that they filed on February 20, 2022 (ECF Nos. 8 and 10), and the renewed emergency motion filed on February 23, 2022 (ECF No. 30).

On March 14, 2022, both defendants and the Carter Intervenors filed motions to dismiss on jurisdictional grounds, respectively.

On March 16, 2022, the district court panel granted the motions to dismiss, finding plaintiffs lacked standing.

On March 28, 2022, plaintiffs filed a Notice of Voluntary Dismissal.
