This case is about a Minnesota law, Minn. This case is about a Minnesota law, Minn. Stat. § 204D.13(2), that requires general election ballots to list the major political party candidates in reverse order based on the average number of votes their party received in the last state general election. Because the Minnesota Democratic Party, called the Democratic-Farmer-Labor Party (DFL), received the highest average vote share in the 2018 general election, the ballot order statute required DFL candidates to be listed last on the 2020 general election ballot after all other major political party candidates. On November 27, 2019, two individual Minnesota voters who supported DFL candidates, the Democratic Senatorial Campaign Committee, and the Democratic Congressional Campaign Committee filed this lawsuit in the U.S. District Court for the District of Minnesota. They sued the Secretary of State of Minnesota under 42 U.S.C. § 1983.

Because extensive academic research shows that being listed higher on a ballot improves electoral success, the plaintiffs alleged the ballot order statute burdened their right to vote and provided an unfair and arbitrary disadvantage to one political party, in violation of the First and Fourteenth Amendments to the U.S. Constitution. Represented by private counsel, the plaintiffs sought declaratory relief, an injunction barring implementation of the statute, attorneys’ fees, and such further relief as the court deemed proper, including requiring a ballot order system providing major-party candidates an equal opportunity to be listed first. The case was assigned to U.S. District Judge Susan R. Nelson.

The defendant filed a motion to dismiss on December 27, 2019, arguing that the plaintiffs failed to state a claim.

On June 15, 2020, the court denied the motion to dismiss and granted the preliminary injunction. The court ruled that the plaintiffs had demonstrated a threat of irreparable harm, a likelihood of success on the merits, and that the balance of harms and public interest favored a preliminary injunction. Accordingly, the court granted a preliminary injunction requiring the Secretary of State to adopt a procedure that would assign by lot the order of the major political parties’ candidates in every partisan race on the ballot for the 2020 general election.

On June 22, 2020, Donald J. Trump for President, Inc., three national Republican committees, and the Republican Party of Minnesota filed a motion to join the case as defendants, with the intent of appealing the preliminary-injunction order. On July 12, 2020, the district court granted that motion. The intervenors then filed an appeal to the U.S. Court of Appeals for the Eighth Circuit regarding the order on the motion to dismiss (docket no. 20-2410).

On July 16, 2020, the U.S. Court of Appeals for the Eighth Circuit denied to stay the district court’s injunction pending appeal. On August 26, 2020, the plaintiffs filed a notice of voluntary dismissal, and the district court dismissed the case without prejudice on the same day. 

In response, the intervenors filed another appeal to the U.S. Court of Appeals for the Eighth Circuit regarding the dismissal (docket no. 20-2814). On September 18, the Circuit Court granted plaintiff's motion to dismiss and ordered the district court to dismiss the preliminary injunction as moot and dismiss the case.

 

On September 21, 2020, the Eighth Circuit dismissed the appeal as moot, ending the case.
