This is a case challenging Georgia's voter registration system that allegedly disproportionately flagged people of color. On October 17, 2018, two civil rights activists filed suit against the Georgia Secretary of State, alleging violations of the National Voter Registration Act. The plaintiffs alleged that the Secretary of State violated provisions of the law mandating that records regarding how voter lists are maintained and purged be retained for at least 2 years and be accessible to the pub…

On October 17, 2018, two civil rights activists filed suit against the Georgia Secretary of State, alleging violations of the National Voter Registration Act. The plaintiffs alleged that the Secretary of State violated provisions of the law mandating that records regarding how voter lists are maintained and purged be retained for at least 2 years and be accessible to the public. Plaintiffs sought declaratory and injunctive relief that defendant provide the 2016 and 2017 Crosscheck lists with full names of those on the lists to plaintiffs, as well as attorney’s fees. 

The plaintiffs alleged the following facts: Georgia participates in the Interstate Voter Crosscheck program, which allows states to check whether a voter is registered in multiple states based on their first and last name. According to plaintiffs, this program ignored other relevant data points and disproportionately flagged people of color. Upon request, the Georgia Secretary of State’s Office did not provide records regarding voters who had been flagged by Crosscheck. After a prolonged back and forth, the Secretary of State’s Office provided only a partial list of voters flagged by Crosscheck. The plaintiffs sought full disclosure of the list in order to confirm their analysis of the list’s false flags and racial bias.

In response, the Secretary State’s Office denied the plaintiff’s factual statements regarding a failure to disclose documents and sought to dismiss the suit on this basis. The Secretary of State sought summary judgement, which the Court denied. The parties then agreed to mediation throughout 2020, but were unable to come to a settlement. The parties later agreed to dismiss the case with prejudice, along with all claims on October 13, 2020. 

The case is now closed.
