In 2018, Georgia Coalition for the Peoples’ Agenda, Inc. and other organizational plaintiffs filed suit in the U.S. District Court for the Northern District of Georgia against the Georgia Secretary of State, initially Brian Kemp and later Brad Raffensperger, challenging Georgia’s voter-registration citizenship verification process for naturalized citizens. The plaintiffs alleged that Georgia’s citizenship-matching protocol delayed and denied active voter-registration status to qualified Georgians, particularly naturalized citizens and disproportionately citizens of color, based on Department of Driver Services data that did not reflect current citizenship status. They asserted claims under Section 2 of the Voting Rights Act, Section 8 of the National Voter Registration Act, and the First and Fourteenth Amendments through 42 U.S.C. § 1983, seeking declaratory and injunctive relief.

The pleadings evolved over time. The original complaint, filed on October 11, 2018, challenged Georgia’s exact match voter-registration protocol generally. On October 19, 2018, plaintiffs filed an amended complaint and an emergency motion for preliminary injunction focused on approximately 3,141 individuals flagged as non-citizens for the November 6, 2018 election. The second amended complaint, filed on December 20, 2019, reflected that Georgia had enacted HB 316 in April 2019, which largely abandoned the broader exact match process and narrowed the case to the citizenship-match aspect of the process. The third amended complaint, filed on July 24, 2020, continued to challenge the citizenship-matching protocol as unlawful under the Voting Rights Act, the National Voter Registration Act, the Equal Protection Clause, and the fundamental right to vote.

The challenged protocol worked by using Georgia’s statewide voter-registration system to compare voter-registration information against Department of Driver Services records. When those records indicated that a registrant had previously been recorded as a non-citizen, the applicant’s registration was placed into pending status until documentary proof of citizenship was provided. Plaintiffs alleged that this process disproportionately burdened naturalized citizens because Department of Driver Services citizenship data often remained outdated after naturalization, and that some applicants who had already submitted proof of citizenship were still flagged and left in pending status.

On November 2, 2018, the district court granted plaintiffs’ emergency motion for preliminary injunction. The court concluded that plaintiffs had shown a substantial likelihood of success on their claim that the citizenship-verification procedure severely burdened the right to vote of those placed in pending status due to citizenship. The court directed the Secretary to allow county election officials to permit eligible voters inaccurately flagged as non-citizens to vote a regular ballot by furnishing proof of citizenship to poll managers or deputy registrars. The court also directed updates to the Secretary of State’s website, additional instructions to county officials, a press release, and posting of acceptable citizenship documents at polling places.

The litigation then proceeded through discovery and dispositive motions. On September 8, 2021, the Secretary filed a motion for summary judgment arguing that plaintiffs lacked standing and that the citizenship-verification process did not violate the Voting Rights Act, Equal Protection Clause, the right to vote, or the National Voter Registration Act. Plaintiffs opposed the motion on October 6, 2021, arguing that the plaintiffs had standing, that the protocol discriminated against naturalized citizens based on national origin, burdened the right to vote, caused discriminatory results under Section 2 of the Voting Rights Act, and violated the National Voter Registration Act by delaying or denying voter registration to eligible applicants.

On September 29, 2022, the district court denied the Secretary’s motion for summary judgment. The court held that the plaintiffs had standing under a diversion-of-resources theory and based on an individual’s June 2020 experience at the polls. The court found genuine disputes of material fact on all counts, including the Section 2 Voting Rights Act claim, the Equal Protection claim, the First and Fourteenth Amendment undue-burden claim, and the National Voter Registration Act claim. The court directed the parties to submit a proposed consolidated pretrial order.

The case proceeded to a bench trial beginning on April 8, 2024. After plaintiffs rested their case on April 10, 2024, the defendant made an oral motion for judgment on partial findings under Federal Rule of Civil Procedure 52(c) as to all claims. On April 11, 2024, Judge Eleanor L. Ross granted the Rule 52(c) motion as to all four claims, set out findings of fact and conclusions of law on the record in open court, directed the Clerk to enter judgment in favor of the defendant on all claims, and closed the case.

On May 9, 2024, plaintiffs moved under Rules 59(e) and 52(b) to alter or amend the judgment as to their National Voter Registration Act claims and to resume or grant a new trial. They argued that the court erred in holding that voters in pending citizenship status were registered voters under the National Voter Registration Act and in concluding that Georgia’s citizenship-verification protocol was uniform and nondiscriminatory. The defendant opposed that motion on May 23, 2024, arguing that plaintiffs had identified no new evidence or error, that persons in pending citizenship status could still vote a regular ballot if they provided proper documentation, and that Georgia’s procedures were uniform and nondiscriminatory. Plaintiffs filed a reply on June 6, 2024, reiterating that pending-status applicants were not treated as registered voters under Georgia law and arguing that the citizenship-verification protocol was non-uniform because it applied only to certain subsets of applicants and required documentary proof of citizenship only from those whose records reflected prior non-citizen status.

On June 24, 2024, the court denied plaintiffs’ motion to alter or amend judgment and to resume or grant a new trial. The court held that the motion did not identify newly discovered evidence, an intervening change in law, or a need to correct clear error or manifest injustice, and instead repeated arguments already made.
