This is a case alleging grievances against President Trump's fitness for the presidency due to his financial records.

Plaintiff, a pro se litigant, filed a case in the Federal District Court for the Northern District of Illinois on August 2, 2018 seeking to enjoin the United States Senate from continuing confirmation proceedings in relation to any United States Supreme Court nominee by President Trump before the President’s financial documents were produced and reviewed. Plaintiff alleged that he voted for Trump and certain actions taken by Trump had contradicted campaign promises.  The case was assigned to Judge Virginia Mary Kendall.

On August 8, 2018, the District Court terminated the case, having found that Plaintiff's complaints amounted to only generalized grievances and that Plaintiff lacked proper standing to bring the claim. The District Court explained that simply being a voter and a citizen does not satisfy the standing requirement. Plaintiff had filed similar claims in the past that had also been denied, which the District Court implied had been frivolous.

On October 9, 2018, Plaintiff moved to amend the complaint, which was denied by the court.

Plaintiff appealed the dismissal to the 7th Circuit (Docket No. 18-3429), which was dismissed on January 19, 2019, for failure to timely pay the required docketing fee.

The case is now closed.

MINUTE entry before the Honorable Virginia M. Kendall. Pro se Plaintiff Alexander Fels originally filed suit on 8/2/2018, styling his complaint as a Motion for Temporary Restraining Order and Germane Subpoena(s) and seeking a subpoena for President Donald Trump's financial documents and an injunction "blocking the Senate confirmation process of President Trump's nominee." (Dkt. 1 ) at 11. The case was screened and Fels's claims were dismissed without prejudice on 8/8/2018 for lack of Article III standing. (Dkt. 9 ). On 8/22/2018, Fels moved for reconsideration; the Court denied the motion on 9/11/2018. (Dkts. 11, 14 ). On 10/9/2018, Fels filed an Amended Complaint seeking "a subpoena for Donald Trump's personal and corporate financial records in an unredacted format" and dropping his request for the Court to enjoin Senate confirmation proceedings because "Judge Brett Kavanaugh's confirmation to the Supreme Court is now a fait accompli." See (Dkt. 15 ). Not only does the Amended Complaint suffer from the same infirmities as the original complaint, the case is closed. Accordingly, Fels's Amended Complaint is dismissed as moot. ORDER: Currently before the Court is pro se Plaintiff Alexander Fel's application for leave to proceed in forma pauperis on appeal (Dkt. 22) For the reasons explained below, Fel's motion is denied. MINUTE entry before the Honorable Virginia M. Kendall. On 11/28/18, pro se Plaintiff Alexander Fels submitted an application for leave to proceed in forma pauperis on appeal 22 . On 12/11/18, Fels filed a second in forma pauperis application 23 . On 12/12/18, the Court issued an order denying Fels's first application. (Dkt. 24 ). Specifically, the Court noted that Fels's first application fails to comply with Fed. R. App. P. 24(a)(1)(C) because it does not contain a list of issues that he plans to present on appeal and also that Fels's appeal is not taken in good faith. Id. Fels's second application is denied for these same reasons. Although at first blush the second application appears to comply with Rule 24(a)(1)(C), the Court's review shows that this application, too, plainly fails to indicate even in general terms the issues Fels's wishes to present on appeal regarding the Courts dismissal of his amended complaint on 10/11/18: Fels intends to appeal "multiple issues raised with the District Court, that were not addressed by the District Court." See (Dkt. 23 ) at 1. Further, the Court remains steady in its conclusion that Fels's appeal is not taken in good faith, because he cannot file an amended complaint in this matter without first successfully moving to vacate or set aside the final judgment entered by the Court on 8/8/18, which he has not done. See (Dkt. 24 ) at 2; see, e.g., Vesely v. Armslist LLC, 762 F.3d 661, 666 (7th Cir. 2014). In sum, Felss second application for leave to appeal in forma pauperis 23 is denied.Mailed notice (lk, ) (Entered: 12/20/2018)
