This is a redistricting case challenging a 2011 Congressional Plan (Louisiana Revised Statute § 18:1276.1), arguing that such plan diluted African-American voting strength and denied African American voters in Louisiana the equal opportunity to elect candidates of their choice for U.S. House of Representatives.

On June 13, 2018, nine African-American registered voters in the State of Louisiana filed suit in the United States District Court for the Middle District of Louisiana. The Plaintiffs sued Louisiana Secretary of State Kyle Ardoin in his official capacity under 42 U.S.C. § 1983 for violations of the Voting Rights Act of 1965 (52 U.S.C. § 10301 et seq.). Plaintiffs claimed that the 2011 Congressional Plan limited minority voting strength in a state with the second-highest percentage of African-American population in the country, by (i) “packing” African-American voters into one majority-minority district (the Second Congressional District), which Plaintiffs argued was significantly more “contorted” than it had been under the prior congressional districting plan adopted in 2001, and (ii) “cracking” African-American voters among other districts (in particular, the Fifth and Sixth Congressional Districts), thereby, submerging minority voters in majority white districts, thereby diluting minority voters’ ability to elect their preferred candidates. Represented by private counsel, Plaintiffs sought declaratory and injunctive relief, including ordering a congressional redistricting plan that includes two majority-minority congressional districts. 

On July 31, 2018, the Defendant filed a motion to dismiss Plaintiffs' complaint on the grounds that (i) the Plaintiffs failed to request a three-judge court pursuant to 28 U.S.C. § 2284, (ii) Plaintiffs lacked standing to bring a claim, and (iii) Plaintiffs failed to state a claim as is required. Defendant argued that even though the Plaintiffs did not expressly raise constitutional claims under the Fourteenth and Fifteenth Amendments to the United States Constitution, the nature of their claims was such that 28 U.S.C. § 2284 (and its requirement for a three-judge court) should apply.  

On September 10, 2018, the Defendant filed a separate motion to dismiss the Plaintiffs' amended complaint, maintaining the same legal positions as Defendant’s initial motion to dismiss, which the Plaintiffs opposed in a memorandum in opposition to Defendant’s second motion to dismiss, filed October 12, 2018.

On February 28, 2019, Defendant filed a motion for protective order, subsequently substituted pursuant to a motion to substitute filed March 1, 2019 (motion to substitute was granted March 12, 2019). The motion for protective order, which sought to stay initial disclosures and discovery until a definitive determination was reached regarding the court’s jurisdiction, was granted by the court on March 14, 2019. 

The court denied Defendant’s first motion to dismiss as moot on March 12, 2019. Again, on May 31, 2019, the court denied Defendant’s motion to dismiss Plaintiffs' first amended complaint, holding that absent a constitutional challenge, a three-judge panel was not required for purely statutory challenges under Section 2 of the Voting Rights Act and finding that the Plaintiffs sufficiently pled a cause of action arising under Section 2 of the Voting Rights Act and the Plaintiff’s allegations were sufficient to confer standing.

On May 20, 2019, Defendant filed a motion for certification of order for interlocutory appeal for review by the United States Court of Appeals for the Fifth Circuit of the court’s order denying Defendant’s motion to dismiss. The court denied this motion on September 12, 2019, noting that the courts ruling denying Defendant’s motion to dismiss was in accordance with decisions of a Fifth Circuit motions and merits panel which reached a similar issue in Thomas v. Bryant (Thomas v. Bryant, 919 F. 3d 298 (5th Cir. 2019)).

On October 7, 2019, Defendant brought a third party action against the Attorney General of the United states and head of the Department of Justice and the United States Department of Justice, arguing that (i) the above third party defendants had a statutorily imposed obligation to assist jurisdictions such as Louisiana to achieve compliance with voting rights requirements before implementing any election change pursuant to Section 5 of the Voting Rights Act, and (ii) conducted a full preclearance review of the 2011 reapportionment and redistricting plan for Louisiana. In the third party complaint, the Secretary of State sought that if the Plaintiffs obtain judgment against the Secretary of State, that the Secretary of State would be entitled to judgment over and against the Attorney General and Department of Justice for errors in their preclearance determination of such redistricting plan. Both the Attorney General and Department of Justice objected to such third party action on the grounds that such claims are barred by the doctrine of sovereign immunity. 

On September 25, 2019, Defendant submitted a motion to stay all proceedings pending the resolution of the United States Court of Appeals for the Fifth Circuit’s review in Thomas v. Bryant, citing that just two days earlier, the United States Court of Appeals for the Fifth Circuit ordered, on its own motion, vacating and rehearing en banc its decision in Thomas v. Bryant, which Defendant argued directly called into question the Court’s denial of the motion to dismiss and motion for certification. 

The court ultimately granted Defendant’s motion to stay on October 17, 2019 in the interest of judicial economy and to avoid attendant litigation expenses to the parties pending resolution of the largely unsettled legal issue.  The court recognized that the stay would impede the injunctive proceedings that the Plaintiffs had hoped to push to conclusion in advance of fall 2020 elections, but that such hardship of delay was outweighed by interests served in granting the stay pending en banc decision in Thomas v. Bryant. 

On September 29, 2020, the court lifted the stay in light of the Fifth Circuit’s issuance of its en banc opinion dismissing the Thomas v. Bryant appeal as moot, without addressing the three-judge panel issue. The Fifth Circuit Court’s concurring opinions address the three-judge panel issue at length, however, noting that a majority of the judges who issued concurring opinions concluded that statutory challenges under Section 2 of the Voting Rights Act may be decided by a single district court judge.  

Pursuant to a joint stipulation of dismissal submitted on October 8, 2020, the parties jointly stipulated dismissal of the action with prejudice, with each party bearing its own costs and attorney fees. Defendant Ardoin also dismissed his complaint against third party defendants William P. Barr and the United States Department of Justice with prejudice. 

This case was dismissed with prejudice on October 13, 2020 in light of the foregoing joint stipulation of dismissal.
