This case challenged the legality of Virginia's voter identification law.

On June 11, 2015, an African American Democrat voter who resided in Virginia, a Latino Democrat voter who resided in Virginia, and the Democratic Party of Virginia filed this lawsuit in the United States District Court for the Eastern District of Virginia, Richmond Division. Plaintiffs sued the Virginia State Board of Elections and the Virginia Department of Elections under Section 2 of the Voting Rights Act, the First Amendment, the Equal Protection Clause of the Fourteenth Amendment, the Fifteenth Amendment, and the Twenty-Sixth Amendment. Represented by private counsel, plaintiffs sought judgement: (1) declaring that the voter ID law and the failure to adequately address long wait lines at the polls to be unconstitutional; (2) issuing a permanent injunction enjoining the Virginia State Board of Elections and the Virginia Department of Elections from enforcing or giving any effect to the voter ID law; (3) holding hearings, considering briefing and evidence, and/or otherwise taking actions necessary to determine what changes must be made to prevent long wait times to vote from recurring in future elections and ordering that such changes be implemented and effectuated; and (4) granting such other or further relief the Court deems to be appropriate, including but not limited to an award of the attorneys’ fees and reasonable costs. Plaintiffs alleged that the photo identification requirement unduly burdened the right to vote, imposed discriminatory burdens on African Americans and Latinos, and was enacted with the intent to discriminate against minorities, young voters and Democrats. The case was assigned to the United States District Judge Henry E. Hudson. 

On August 14, 2015, plaintiffs filed an amended complaint.

On August 28, 2015, the Virginia State Board of Elections and the Virginia Department of Elections filed a motion to dismiss. Defendants requested that the court dismiss for lack of subject matter jurisdiction, specifically absence of Article III standing. They also requested that the court dismiss the Amended Complaint for failure to state a claim upon which relief can be granted. Plaintiffs filed their opposition to the motion to dismiss on September 15, 2015.

On December 18, 2015, the court issued an order granting in part defendants' motion to dismiss.

On December 23, 2015, the court issued a Consent Decree. Under the Consent Decree, the parties agreed on various matters including: Voting Equipment and /or Electronic Poll Book Mechanical Failure or Malfunction; Pre-Election Resource Allocation Planning; Provision of Election Administration Consultants and Experts for BOBs; Transparency of Voting Equipment Information; and Long-Term Promotion of Voting Equipment Uniformity.

On January 11, 2016, the plaintiffs filed the motion for reconsideration. Plaintiffs argued that they were not afforded the opportunity to fully address the standing issue on which the dismissal of Counts IV and V was based.

On January 20, 2016, the court granted the motion to reconsider, reasoning that further briefing and consideration of the standing issue on Counts IV and V was appropriate.

On February 2, 2016, the court issued an order granting plaintiffs' motion to reinstate counts IV and V. In the order, the court ordered that Counts IV and V of the Amended Complaint were reinstated since the plaintiffs persuaded the court that the motion to dismiss on Counts IV and V was improvidently granted.

On February 5, 2016, the defendants filed a motion for partial summary judgment.  Defendants argued that the defendant Democratic Part of Virginia did not have standing to assert claims on behalf of individual voters who were allegedly affected by the law. 

On February 8, 2016, the court issued an order stating that the matters raised in the motion for partial Summary Judgement will be reserved for argument post-trial as part of argument on the merits.

On May 19, 2016, the court issued the Final Opinion along with the Memorandum Opinion. In the Final Opinion, the court denied the Motion for Partial Summary Judgment, dismissed Counts I through V of the Amended Complaint, and denied the African American Democrat voter who resided in Virginia, the Latino Democrat voter who resided in Virginia and the Democratic Party of Virginia's request for injunctive relief. The court reasoned that, while the court found the African American Democrat voter who resided in Virginia, the Latino Democrat voter who resided in Virginia and the Democratic Party of Virginia had standing to pursue the claims contained within the Amended Complaint, they had failed to prove by a preponderance of the  evidence that the Virginia voter ID law, either in its enactment or implementation, contravened the Voting Rights Act, First Amendment, Fourteenth Amendment, Fifteenth  Amendment, or the Twenty-Sixth Amendment.

On May 25, 2016, after the district court found that the plaintiffs had failed to present evidence sufficient to support their claim, they filed Appeal to the United States Court of Appeals for The Fourth Circuit.

On December 13, 2016, Judge Paul Victor Niemeyer, Judge Dennis W. Shedd and Judge G Steven Agee issued the Opinion that affirmed the District Court’s judgement. In the Opinion, the court affirmed the district court’s judgement that the plaintiffs had failed to present evidence sufficient to support their claims. First, the African American Democrat voter who resided in Virginia, the Latino Democrat voter who resided in Virginia and the Democratic Party of Virginia contended that SB 1256 violated § 2 of the Voting Rights Act of 1965 in that it imposed a discriminatory burden on African Americans and Latinos, such that they had less opportunity to vote than do Caucasians. However, the court concluded that § 2 did not sweep away all election rules that resulted in a disparity in the convenience of voting. Second, they contended that SB 1256 violated the Constitution in that SB 1256 was enacted with the intent to discriminate on the basis of race, in violation of the Fourteenth and Fifteenth Amendments. However, the court concluded that the district court’s factual findings with respect to this issue were not clearly erroneous. Third, they contended that even if SB 1256 was enacted without racially discriminatory intent, it was, nonetheless, unconstitutional because it placed an undue burden on the constitutionally protected right to vote. However, the court concluded that SB 1256 did not impose an unconstitutional burden on the right to vote in light of Crawford, 553 U.S. at 193, Anderson v. Celebrezze, 460 U.S. 780 (1983) and Burdick v. Takushi, 504 U.S. 428 (1992). Finally, they alleged that SB 1256 violated their rights under the Twenty-Sixth Amendment. However, the court agreed to the district court’s finding that the African American Democrat voter who resided in Virginia, the Latino Democrat voter who resided in Virginia and the Democratic Party of Virginia failed to show that SB 1256 was intended, either in its enactment or implementation, to discriminate against young voters.
