This is a case challenging, in part, the constitutionality of Tennessee's voter identification law, which excludes, among other things, student ID cards issued by higher education institutions as a form of acceptable identification for in-person voting. 

On March 4, 2015, a group comprised of several individual Tennessee students, together with the Nashville Student Organizing Committee, a social justice and civil rights non-profit organization, filed this lawsuit in the United States District Court for the Middle District of Tennessee, Nashville Division. The plaintiffs sued the Tennessee Secretary of State, and the Coordinator of Elections in the Office of the Secretary of State, under 42 U.S.C. § 1983. 

Represented by Fair Elections Legal Network, a DC-based voting rights organization, and Barret Johnston Martin & Garrison, PLLC, a Nashville, TN-based civil rights law firm, the plaintiffs sought (1) a declaratory judgment that Tennessee’s voter ID law, by excluding college student ID cards from the list of qualified photo IDs required for in-person voting, violated the Fourteenth Amendment and the Twenty-Sixth Amendment to the United States Constitution and the laws of the United States, and (2) an injunction requiring the Tennessee Secretary of State, for purposes of in-person voting under Tennessee state law, to accept student ID cards issued by any accredited postsecondary educational institution in Tennessee. 

The plaintiffs claimed that obtaining a non-driver photo ID from the state's driver's service centers, which were not easily accessible by public transportation and only open from 8:30-5:30 on weekdays were burdensome for college students, and alleged that legislative debate demonstrated that the legislators were aware of the rigorous process of issuing student ID cards but still excluded them from the list of acceptable photo IDs to discourage young people from voting. 

Throughout the discovery process, the plaintiffs issued subpoenas to current and former state legislators to produce documents and testify. The plaintiffs initially issued (and, in certain cases, re-issued multiple times after failure to serve) subpoenas in June and July of 2015 for the production of documents and, after receiving limited record of documents in response thereof, issued subpoenas for depositions. The plaintiffs and the defendants were unable to resolve their concerns regarding the depositions. On August 12, 2015, the court issued an order allowing the plaintiffs to proceed with the depositions scheduled on August 25 and 26, 2015, citing the dearth of documentary evidence and the important constitutional issue involved in the litigation. 

After the scheduled depositions, the plaintiffs issued additional subpoenas to produce documents and testify to the Tennessee Department of General Services, the Tennessee General Assembly and the Tennessee Department of Safety and Homeland Security on September 8, 2015 and filed an amended complaint on September 9, 2015. The defendants filed a motion to dismiss the plaintiffs' amended complaint on September 25, 2015.  After a dispute telephone conference on September 29, 2015, the court ordered that discovery be stayed until the court could reach a decision on the motion to dismiss.

On December 21, 2015, the court issued an order granting the defendants' September 25, 2015 motion to dismiss. With respect to the plaintiffs' Fourteenth Amendment claim, the court (1) noted that the alleged discriminated group - college students - is not a protected class, (2) citing Crawford v. Marion County Election Bd., 553 U.S. 181 (2008), noted that the requirement to obtain a photo ID from the state's driver's service centers did not pose a substantial burden on the fundamental right to vote, and (3) noted that the state's interest in preventing voter fraud in light of higher education institutions' different relationship with faculty and staff versus with its students and the greater likelihood of falsified student ID passed rational basis review.  With respect to the plaintiffs' Twenty Sixth Amendment claim, the court found that the burden to obtain an alternative, approved form of voter ID was not substantially burdensome.

The case closed thereafter.
