This case is about whether North Carolina state and congressional electoral maps drawn in 2023 diminished the voting power of the state’s Black voters in violation of the Voting Rights Act (VRA) and the United States Constitution.

On December 19, 2023, the North Carolina State Conference of the NAACP, Common Cause, and individual North Carolina voters brought this lawsuit against the North Carolina State Legislature in the United States District Court for the Middle District of North Carolina. Named defendants included the President Pro Tempore of the North Carolina Senate; the Speakers of the North Carolina House; the Chair of the North Carolina House of Representatives Redistricting Committee; and others. Represented by the Southern Coalition for Social Justice, the NAACP, and private counsel, the plaintiffs alleged that the drawing of Ohio districts constituted discrimination against Black voters in the State Senate, State House, and Congress; intentional vote dilution of Black electoral power in the State Senate, State House, and certain congressional districts; and a violation of the one-person, one-vote principle in the State Senate and House. The complaint contained 12 counts brought under either the VRA or 42 U.S.C. § 1983 alleging that various aspects of the maps in question violated Section 2 of the Voting Rights Act (52 U.S.C. § 10301(a)) as well as the Fourteenth Amendment's Equal Protection Clause and the Fifteenth Amendment. The plaintiffs sought a declaratory judgment, a permanent injunction preventing North Carolina from holding elections under the plans in question, an order requiring the State Legislature to redraw the election maps, and attorneys’ fees. The plaintiffs requested a three-judge panel to hear the case pursuant to 28 U.S.C. § 2284(a); Circuit Judge Allison J. Rushing along with District Judges William L. Osteen Jr. and Richard E. Myers II were assigned to hear the case.

Under § 2 of the VRA, redistricting plans may not minimize or cancel out the voting strength of racial minorities in the voting population. A § 2 violation may be established either by proving the challenged measure was adopted with discriminatory intent or by proof of discriminatory results. The complaint alleged that race predominated in drawing the boundaries of various districts across the three maps, indicating discriminatory intent; that the maps divided Black voters in a way that reduced majority-Black districts; and that some districts were malapportioned because their populations arbitrarily deviated from the rest of the districts in violation of the Fourteenth Amendment's one-person, one-vote principle.
