The Iowa governor signed SF 496 into law on May 26, 2023. The Iowa governor signed SF 496 into law on May 26, 2023. SF 496 includes an Age-Appropriate Standard, an Identity and Orientation Prohibition, a Library Restriction provision (together, the Book Restriction provisions), and a Parental Notice provision. The Age-Appropriate Standard dictates that school libraries must contain “only age-appropriate materials” which cannot include “any material with descriptions or visual depictions of a sex act.” SF 496 defines sex act broadly and does not account for the value of a book as a whole or its literary, scientific, medical, artistic, or political value. The Age-Appropriate Act also draws no distinction between what is appropriate for a kindergartener versus a high school student.  The Identity and Orientation Prohibition also prohibits school libraries from providing any program or promotion relating to “gender identity” or “sexual orientation” to students in kindergarten through sixth grade. SF 496 does not define what constitutes a program or promotion, nor does it provide guidance was to what types of materials “relate” to gender identity or sexual orientation. Under SF 496, teachers, libraries, and other educators face license sanctions and adverse employment actions for violations of SF 496, including termination of their employment. The Library Restriction provision facilitates anonymous complaints by parents requesting the removal of material from classrooms and libraries. Finally, the Parental Notice provision mandates that school officials notify a student’s parent or guardian when the student asked to use a name or pronouns that differ from those in the school’s records, even if the official is aware that a student will be rendered unsafe or vulnerable to abuse as a result. SF 496 was set to go into effect on January 1, 2024.

On November 28, 2023, an LGBTQ+ non-profit and eight students attending Iowa schools brought this lawsuit in the United States District Court for the Southern District of Iowa. Represented by the ACLU of Iowa, Lambda Legal, and private counsel, plaintiffs brought this lawsuit against the Governor of Iowa, the Iowa Department of Education (IDOE), the director of IDOE, the Iowa State Board of Education (ISBE), the Iowa City Community School District, the Sioux City Community School District, the Urbandale Community School District, the Waterloo Community School District, and the West Des Moines Community School District, as well as each of the school district superintendents and individual members of their school boards. Plaintiffs alleged that the Age-Appropriate Standard and Identity and Orientation Prohibition provisions of SF 496 violated Plaintiffs’ First and Fourteenth Amendment rights in several ways:

  • The Book Restriction provisions constituted content- and viewpoint-based restrictions on the right to receive information in violation of Student Plaintiffs’ First and Fourteenth Amendment rights.
  • The Book Restriction and Parental Notice provisions violated all Plaintiffs’ rights under the First and Fourteenth Amendment by chilling and depriving their freedom of speech and expression.
  • The Book Restriction and Parental Notice provisions violated all Plaintiffs’ rights under the First and Fourteenth Amendment by depriving their freedom of expressive association.
  • The Book Restriction and Parental Notice provisions violated all Plaintiffs’ rights under the First and Fourteenth Amendment because it was unconstitutionally vague.
  • The Book Restriction provisions violated all Plaintiffs’ rights under the First and Fourteenth Amendment because it was unconstitutionally overbroad.
  • The Book Restriction and Parental Notice provisions violated the rights of all Plaintiffs to Equal Protection under the Fourteenth Amendment by discriminating on the basis of sex, sexual orientation, gender identity, and transgender status.
  • The Book Restriction and Parental Notice provisions violated all Plaintiffs’ rights under the Equal Access Act, 20 U.S.C. § 4071, by denying equal access or a fair opportunity to Gay Straight Alliances in schools.

Plaintiffs asked that the court grant declaratory relief, attorneys’ fees and costs, and permanent injunctive relief enjoining defendants from enforcing the relevant provisions of SF 496. The case was assigned to Judge Stephen H. Lochner and Magistrate Judge Stephen B. Jackson.

Contemporaneously with their complaint, on November 28, 2023, Plaintiffs filed a motion for preliminary injunction, asking the court to enjoin defendants form enforcing SF 496 while the litigation proceeded. On December 19, 2023, school district defendants filed their opposition to Plaintiffs’ motion for preliminary injunction, and the state defendants filed their opposition on December 20.

The school district defendants also filed a motion to dismiss for failure to state a claim on December 20, arguing that (1) the school district defendants were not the moving force behind Plaintiffs’ injuries, (2) the school district defendants could not be held liable for following state law, and (3) alternatively, the claims against the individual school district officials should be dismissed as duplicative of the claims against the school districts.

The court held oral argument regarding Plaintiffs’ motion for preliminary injunction on December 22, 2023. This oral argument was held simultaneously with the oral argument for a motion for preliminary injunction in Penguin Random House, LLC v. Robbins, 4:23-cv-00478, which also challenged the constitutionality of SF 496.

On December 29, 2023, the district court granted in part Plaintiffs’ motion for preliminary injunction. The court enjoined defendants from enforcing the Book Restriction provisions, but denied Plaintiffs’ motion for preliminary injunction as it pertained to the Parental Notice provision. The court first analyzed which plaintiffs had standing to challenge which provisions of SF 496. The court found that students had standing to challenge the Book Restriction provision because it directly restricted what books they could access in their school’s library. However, seven of eight Student Plaintiffs did not have standing to challenge the Book Restriction provisions insofar as Student Plaintiffs argued that such provisions restricted their freedom of speech or association, as the court found that any such restriction was a result of Plaintiffs’ perception of the law rather than the law itself. Only one Student Plaintiff had standing to bring such a first amendment challenge because she was the only plaintiff under grade six, and SF 496 therefore posed stricter restrictions on her compared to her co-plaintiffs. Additionally, the court found that no Student Plaintiff had standing to challenge the Parental Notice provision because all of the named Student Plaintiffs were already out to their families and as such suffered no concrete injury. Turning to the merits of parties’ arguments, the court found that the Age-Appropriate Standard was overbroad and unlikely to survive any standard of scrutiny and that the Identity and Orientation Prohibition, while facially neutral, was likely void for vagueness under the Fourteenth Amendment. For these reasons, the court enjoined defendants from enforcing the Book Restriction provisions while the case proceeded. 2023 WL 9052113.

The state defendants appealed the court’s order on preliminary injunction on January 12, 2024 to the United States Court of Appeals for the Eighth Circuit (24-1075).

On January 17, 2024, defendants filed a motion to stay proceedings in the district court pending the appeal in the Eighth Circuit. On the same day, the district court temporarily granted the motion, asking Plaintiffs and school district defendants to respond to their motion explaining how they would be harmed by a stay pending appeal. Following motion practice, the district court partially lifted the stay, setting a deadline for Plaintiffs to respond to school district defendants’ motion to dismiss. Plaintiffs filed their opposition on February 27, 2024, and school district defendants filed their reply on March 8, 2024.

In the district court, Plaintiffs filed a motion to allow limited discovery and motion practice on May 21, 2024. Specifically, Plaintiffs asked to proceed with limited discovery against the school board defendants only. Plaintiffs also asked to move to amend their complaint only as it pertained to claims not on appeal in the Eighth Circuit. Finally, Plaintiffs asked for leave to move to renew their motion for preliminary injunction as to the Parental Notice provision, as they sought to amend their complaint with facts demonstrating injury and standing. The district court granted the motion on May 23, 2024, allowing Plaintiffs to proceed with limited discovery and move to amend their complaint a renew their motion for preliminary injunction. The Plaintiffs filed their motions the same day. Also on the same day, state defendants moved for the court to reconsider its order granting Plaintiffs’ motion, arguing allowing Plaintiffs to amend their complaint now as opposed to after the Eighth Circuit ruled on their appeal would prejudice them significantly. On May 24, the district court denied defendant’s motion to reconsider and Plaintiffs’ motion to amend but gave both parties leave to refile.

On the same day, in the Eighth Circuit, the state defendants moved to stay proceedings in the district court pending their appeal. The Eighth Circuit granted defendants’ motion on May 28, 2024 without giving their reasoning. In response to the circuit court’s order, the district court denied school district defendant’s motion to dismiss and Plaintiffs’ renewed motion for preliminary injunction on May 29, 2024, and stayed all proceedings in the district court.

The Eighth Circuit set oral argument for June 11, 2024. As of July 14, 2024, all proceedings in the district court are stayed, and defendants’ appeal of the district court’s preliminary injunction is pending in the Eighth Circuit.

All parties in Case No. 4:23-cv-00474 and Case No. 4:23-cv-00478 have now responded and confirmed that they do not intend to offer live testimony at the hearing on the motions for preliminary injunction. The Court is therefore satisfied that the single consolidated hearing on December 22, 2023, at 9:00 a.m., will be sufficient to address the motions in both cases. Accordingly, the Court DENIES the Penguin House Plaintiffs' request for a separate hearing. The Court anticipates the following order of events at the December 22 hearing: (1) the GLBT Youth Plaintiffs will present argument on their motion; (2) the Penguin House Plaintiffs will present argument on their motion; (3) the State of Iowa Defendants will present argument in response to both the GLBT Youth and Penguin House motions; (4) any other Defendants wishing to be heard will present argument; (5) the GLBT Youth Plaintiffs will present rebuttal argument, if any; and (6) the Penguin House Plaintiffs will present rebuttal argument, if any. There are no other hearings scheduled before the undersigned on December 22, and thus all parties will be given as much time as they reasonably believe they need to argue their positions.
