This case concerns allegations that the Environmental Protection Agency (“EPA”) failed to protect children from the impacts of climate change. On December 10, 2023, eighteen California children filed this lawsuit in the U.S. District Court for the Central District of California. They sued the EPA, United States, and EPA Administrator under the Declaratory Judgment Act.  Represented by the non-profit organization, Our Children’s Trust, the University of California Irvine School of Law Civil Rights Litigation Clinic, and private counsel, the plaintiffs sought declaratory relief stating that the defendants had violated their fundamental rights to life, including their personal security and happiness, by failing to protect them from the impacts of climate change. They also sought costs and reasonable attorneys’ fees.

In count one, the plaintiffs asserted that the defendants violated Fifth Amendment requirements of equal protection by intentionally allowing climate pollution and burdening children with lifetimes of hardship. In count two, the plaintiffs alleged that they fell within the protected class of children and that the defendants intentionally discriminated against the class by discounting the value of their lives in decisions concerning climate pollution. In count three, the plaintiffs claimed that the defendants violated their Fifth Amendment substantive due process right to life by intentionally allowing life-threateningly high levels of climate pollution. In count four, the plaintiffs asserted that a stable climate system capable of sustaining human life was fundamental to the Fifth Amendment's due process rights to life, liberty, and property, and that the defendants violated this fundamental right to a stable climate system. In count five, the plaintiffs alleged that the EPA violated the Constitution and separation of power principles by exceeding its authority as delegated by Congress under Article I and by failing to faithfully execute the law under Article II. The case was assigned to District Judge Michael W. Fitzgerald and Magistrate Judge Alicia G. Rosenberg.

On March 15, 2024, the defendants moved to dismiss the case, arguing that the court lacked subject matter jurisdiction because the plaintiffs’ suit was barred by sovereign immunity, the plaintiffs lacked standing, and the complaint fails to assert a justiciable controversy. Alternatively, the defendants argue that the complaint should be dismissed because the plaintiffs’ failed to state a legal claim. On May 8, 2024, the court granted this motion to dismiss, finding that the plaintiffs lacked standing because the declaratory judgment that they would not redress the injuries they allege. 2024 WL 3009302. 

On May 20, the plaintiffs filed an amended complaint. The complaint shifted from alleging harms related to EPA’s general allowance of climate pollution to specifically challenging EPA’s use of discount rates in economic analyses. Specifically, the plaintiffs alleged that by discounting future harms in performing cost benefit analyses, EPA was unconstitutionally discriminating against children by devaluing their lives as compared to current adults. Additionally, the complaint added a prayer for injunctive relief, seeking a permanent injunction preventing EPA from using discriminatory policies and practices in its regulatory programs. Additionally, the plaintiffs sought a permanent injunction requiring the EPA to conduct regulatory analyses and cost benefit analyses in a manner that does not discriminate against children. 

On July 22, the defendants filed a second motion to dismiss, alleging that, despite the amendments to the complaint, the plaintiffs’ still lacked standing and failed to state a claim. Agreeing that the plaintiffs continued to lack standing, the court granted this motion to dismiss on February 11, 2025. The court found that the plaintiffs could not trace their injuries to the specific discounting practices, and that they had failed to prove that any discrimination had occurred. 2025 WL 578354. 

On April 10, the plaintiffs filed an appeal with the Ninth Circuit Court of Appeals. On April 9th, 2026, the Ninth Circuit affirmed the District Court’s dismissal of the case. 2026 WL 959839.
