This case involves allegations that the NYU Law Review’s membership selection policies are discriminatory on account of race or sex. On December 1st, 2023, a first-year New York University (NYU) law student—a white, heterosexual male who plans to apply for membership on the NYU law Review in the summer of 2024—filed this lawsuit in the United States District Court for the Southern District of New York. He sued NYU under Title VI of the Patriot Act and Title IX of the Education Amendments of 1972. Represented by Murray-Nolan Berutti LLC, Spero Law LLC, Mitchell Law PLLC, and America First Legal Foundation, the plaintiff sought class certification, as well as declaratory and injunctive relief preventing the NYU Law Review from discriminating on account of race or sex in any manner when selecting its student members and editors. The plaintiff alleged that the NYU Law Review’s selection policy, which involves soliciting resumes and personal statements to fulfill diversity goals and allocating spots for selections made by the law review’s Diversity Committee, unlawfully favors women, non-Asian racial minorities, and LGBTQ+ individuals. The plaintiff further alleged that the NYU Law Review is prohibited from engaging in such practices because it is a ”program or activity” that “receives Federal financial assistance” within the meaning of Title VI and IX, which prohibit discrimination on account of race or sex. 

On January 24, 2024, the plaintiff filed a motion to certify the class. On January 29, NYU filed a motion to dismiss the complaint. This case is still ongoing.

The Clerk of Court shall terminate the motion at ECF No. 25. Once the NYU Law Review has issued its operative criteria for selection to the Law Review, the parties may meet and confer to discuss whether limited and targeted discovery in aid of an anticipated motion for preliminary injunctive relief is appropriate.
