This case challenges Washington County’s practice of dispatching armed law enforcement officers, rather than qualified mental health professionals, as first responders to mental health emergencies. On February 5, 2024, a private individual and Disability Rights Oregon filed this lawsuit in the U.S. District Court for the District of Oregon against Washington County and the Washington County Consolidated Communications Agency (“WCCCA”), the County’s 911 dispatch center. The plaintiffs brought this action under Title II of the Americans with Disabilities Act of 1990 (“ADA”) and Section 504 of the Rehabilitation Act of 1973 (“Section 504”). Represented by private counsel, Disability Rights Oregon, and the ACLU, the plaintiffs sought declaratory and injunctive relief to enjoin the defendants from their discriminatory provision of mental health emergency response services and require the defendants to take appropriate steps to ensure the people in Washington County with mental health disabilities are provided equal access to, and equal opportunity to benefit from the defendants’ emergency response services and programs. The plaintiffs also sought costs and reasonable attorneys’ fees.
 
Disability Rights Oregon is a Protection and Advocacy System (“P&A”) mandated under federal law to “ensure that rights of individuals with mental illness are protected.” The Protection and Advocacy for Individuals with Mental Illness Act, 42 U.S.C. §§ 10801, provided for the establishment and funding of systems within each state designed to protect and advocate for the rights and individuals with mental illness, as well as to investigate incidents of abuse and neglect of those with mental illness. The system established by each state to protect and advocate for the rights of individuals with mental health disabilities must have the authority to pursue administrative, legal, and other appropriate remedies to ensure the protection of individuals with mental illness who are receiving care or treatment in the State. 42 U.S.C. § 10805(a)(1)(B). Disability Rights Oregon brought this action on behalf of its members, clients, and constituents with mental health disabilities in Washington County, alleging the defendants discriminated against people with mental health disabilities by failing to provide them equal access to, and opportunity to benefit from, Washington County’s emergency response system. Disability Rights Oregon claimed when someone in Washington County called 911 for a physical health emergency, a dispatcher sent trained health professionals, such as paramedics or EMTs. But when someone in the county called 911 seeking help for a potential mental or behavioral health issue for themselves or others, a dispatcher sent armed law enforcement officers. The complaint alleged armed law enforcement officers’ presence created a substantial risk that they exacerbate, rather than alleviate, the mental health crises they were intended to address.
 
The complaint further alleged that the private plaintiff, who lived with depression and Post Traumatic Stress Disorder and on occasion, experienced bouts of psychosis that involved auditory hallucinations and/or suicidal ideation, called WCCCA for a mental health emergency in August 2022, stating he was experiencing suicidal ideation and specifically contemplating law-enforcement-assisted suicide. In response to the plaintiff’s mental health crisis, Washington County sent armed deputies. Three months later, the plaintiff called a crisis hotline for a mental health emergency on October 24, 2022. Instead of sending trained clinicians to aid the plaintiff, as he specifically requested, the hotline transferred the plaintiff’s call to the local 911 dispatch center, which sent several armed deputies to the plaintiff’s residence. The plaintiff alleged that the deputies did not take the steps a qualified mental health professional would have taken on the scene, failing to provide on-site psychiatric assessment, stabilization, and treatment by a qualified mental health professional. At the hospital, the plaintiff attempted to take one of the deputies’ firearms while repeating “[l]et me kill myself.” The deputy stabbed the plaintiff multiple times with a knife to prevent him from taking the firearm. The plaintiff claimed the deputies needlessly escalated the situation.
