This case, originally captioned as Williams v. Wells Fargo, is about whether Wells Fargo illegally discriminated against non-white applicants for home mortgage loans or refinancing options. On February 17, 2022, a Black home borrower from Georgia brought a putative class action lawsuit against Wells Fargo in the U.S. District Court for the Northern District of California. The original complaint alleged that Wells Fargo maintained a nationwide set of discriminatory mortgage loan origination and underwriting practices and engaged in a pattern or practice of systemic race discrimination against Black mortgage loan applicants, in violation of the Equal Credit Opportunity Act (15 U.S.C. § 16901, et seq.), Sections 1 and 2 of the Civil Rights Act of 1866 (42 U.S.C. §§ 1981, 1982), and the Fair Housing Act (42 U.S.C. § 3601, et seq.). 

The case was assigned to Magistrate Judge Donna M. Ryu. On March 3, 2022, Wells Fargo declined to proceed before a Magistrate Judge. The case was subsequently reassigned to District Judge James Donato. On April 14, 2022, the plaintiff filed an amended complaint that further detailed the factual allegations against the bank and added two additional named plaintiffs to the lawsuit. Represented by private counsel, plaintiffs sought declaratory relief, injunctive relief to stop the alleged discriminatory practices, restitutionary relief, compensatory damages, punitive damages, and attorneys’ fees. 

In the wake of a Bloomberg report that found that Wells Fargo had accepted only 47 percent of all Black borrowers’ refinancing applications in 2020, while other lenders had approved a combined 71 percent of their Black customers’ applications, further lawsuits against the bank ensued. From March to June 2022, five additional putative class action lawsuits were filed against Wells Fargo in the Northern District of California that alleged similar claims of racial discrimination by the bank. Judge Donato related each of these cases with this case; they were all reassigned to him.

Braxton v. Wells Fargo (filed March 18, 2022):

Perkins v. Wells Fargo (filed June 10, 2022):

The parties then turned to the issue of consolidation. On October 11, 2022, Judge Donato ordered Wells Fargo and the plaintiffs in each related case to submit statements regarding their respective positions on consolidation. In Wells Fargo’s report, filed on November 4, 2022, the bank stated that it believed that one consolidated complaint was appropriate, but that it was also amenable to one complaint for refinancing products and another complaint for purchase mortgages. In a joint report filed by all of the plaintiffs in the six related cases on November 18, 2022, the plaintiffs proposed filing two complaints: (1) a consolidated complaint, filed by the Braxton/Williams group, on behalf of a class of Black applicants and borrowers, including origination and refinance mortgages, and (2) a consolidated complaint, filed by the Pope/Ebo/Thomas/Perkins group, on behalf of a class of non-Black protected minorities, including both loan origination and refinance applicants. 

On January 18, 2023, all six related cases were consolidated into a single action. In his order, Judge Donato noted that “[a]ll of the complaints allege the same theory, namely that Wells Fargo discriminated against non-white customers with respect to residential mortgages and refinances.” Judge Donato justified his decision to not split the case into one complaint for Black applicants and another for non-Black applicants by noting that while “some plaintiffs [Black applicants]” may have “experienced more discriminatory conduct and impacts than others,” that was “a difference of degree and not substance.” The consolidated case was captioned as “In re Wells Fargo Mortgage Discrimination Litigation” under the 3:22-cv-00990 case number. Judge Donato ordered the plaintiffs to file one amended, consolidated complaint.

The parties turned to the issue of the appointment of interim lead counsel. After different plaintiff groups submitted applications for interim lead appointment, Judge Donato selected Dennis S. Ellis, of Ellis George Cipollone O’Brien Annaguey LLP, as interim lead class counsel. Attorney Ellis brought the original complaint in the Braxton case. Judge Donato stated that Ellis would serve as interim lead counsel for “all claims[,] irrespective of the bank products involved (original loan or refinancing), or race or ethnicity of the loan applicants.”

The plaintiffs filed their amended, consolidated complaint on March 24, 2023. The amended complaint alleged that Wells Fargo engaged in “digital redlining” by using algorithms that drew on historical data to make lending and refinancing decisions that exacerbated existing racial disparities. Furthermore, the complaint alleged that Wells Fargo failed to properly monitor and correct the lending algorithms, and thus, the company intentionally and disproportionately discriminated against applicants based on their race and ethnicity. 

The plaintiffs defined the proposed class as “all Minority Applicants in the United States who, from January 1, 2018 through the present (the “Class Period”), submitted an application for a original purchase or other home mortgage loan or to refinance or modify a home mortgage loan through Defendants that was (i) denied; (ii) approved at higher interest rates or subject to less favorable terms as compared to similarly situated non-Minority Applicants; or (iii) processed at a rate slower than the average processing time of applications submitted by similarly situated non-Minority Applicants.”

The plaintiffs also proposed two sub-classes. The first, the “Denial Subclass,” was defined as members of the class “whose applications were denied but would have been approved had such applications been submitted by similarly situated non-Minority Applicants.” The second, the “Delayed, Higher Rate or Less Favorable Terms Subclass,” was defined as members of the class “whose applications were (a) processed at a rate slower than that of the average processing time of applications submitted by non-Minority Applicants; or (b) whose applications were eventually approved, but at higher interest rates or subject to less favorable terms than similarly situated non-Minority Applicants.”

The plaintiffs brought claims under the Equal Credit Opportunity Act, the Fair Housing Act, Section 1 of Civil Rights Act of 1866, and California civil rights and consumer protection laws. Represented by an array of private law firms, plaintiffs plaintiffs sought declaratory relief, injunctive relief to stop the alleged discriminatory practices, restitutionary relief, compensatory damages, punitive damages, and attorneys’ fees. 

Wells Fargo filed its answer on May 17, 2023. The parties then turned to discovery issues. From May 2023 to March 2024, the parties filed multiple motions regarding amending the scheduling order and compelling discovery requests. On March 5, 2024, Judge Donato stated in an order that “[t]he parties have filed an inordinate number of discovery letter briefs,” and he directed the parties to file a status report identifying discovery issues by April 5, 2024. On April 5, 2024, the parties identified one outstanding discovery dispute regarding Plaintiffs’ failure to fully answer Wells Fargo’s Second Set of Interrogatories concerning the identification of Wells Fargo’s policies and practices that resulted in a disparate impact.

The case is still ongoing.
