This case involves a student group at West Texas A&M University that was prohibited from hosting a drag show. On March 24, 2023, a student group and two individuals brought suit against the President of West Texas A&M University, in his individual and official capacities, as well as the Vice President for Student Affairs, the university chancellor, and the Board of Regents in their official capacities. Represented by the Foundation for Individual Rights and Expression, the students sued under 42 U.S.C. § 1983, alleging that the university violated the First Amendment’s free speech protections when the President of the university published an open letter prohibiting the group from putting on a PG-13 drag show to raise money for LGBT+ suicide prevention. The students sought injunctive relief to allow the drag show to go on as planned and in future years, a declaratory judgment that their First Amendment rights were violated, compensatory and punitive damages, and attorneys' fees and costs. The case was filed in the U.S. District Court for the Northern District of Texas and assigned to Judge Matthew J. Kacsmaryk.

The plaintiffs filed an amended complaint on April 18, 2024 and an amended motion for preliminary injunction on April 20, 2023. The complaint was amended because the students held the drag show off- campus, but continued the lawsuit for fear of future programming (including the annual drag show) being prohibited by the university president. The defendants filed motions to dismiss on May 5, 2023. The court issued an order on May 9, 2024, finding the temporary restraining order issue moot because the plaintiffs filed an amended motion for a preliminary injunction that superseded the motion for a temporary restraining order. 

On September 21, 2023, Judge Kacsmaryk granted the defendants' motion to dismiss in part, and denied the plaintiffs’ motion for a preliminary injunction. He found that the university President was entitled to qualified immunity from damages because no precedent clearly established that drag shows at school were protected speech, the President's actions were not viewpoint discriminatory, and the President’s conduct forbidding the drag show was not objectively unreasonable because the show could have led to potential lewdness that was prohibited by school rules. The court also found that the plaintiffs had standing against the Vice President of Student Affairs and the Chancellor because they could enforce the President’s policy choices, but the plaintiffs lacked standing to bring suit against the Board of Regents defendants because there was no evidence that the Board played any role in enforcing the President’s decisions. The court additionally denied the plaintiffs’ request for a preliminary injunction because they had not shown that they were likely to succeed on the merits of their claim. 693 F.Supp.3d 689.

Following the denial of their preliminary injunction, the students filed an interlocutory appeal to the U.S. Court of Appeals for the Fifth Circuit on September 26, 2023. The students filed a motion to expedite the appeal for decision before March 15, 2024, the date of their next annual drag show, but this request was denied on October 11, 2023.

On September 26, 2023, the plaintiffs submitted an unopposed motion for judgment in the district court, asking the court to issue a decision on the First Amendment issue so the whole case could be heard on appeal. On October 3, 2023, Judge Kacsmaryk denied the motion because factual development was necessary to rule on the First Amendment issue. The plaintiffs moved for reconsideration, but the court denied the motion later that month, on October 13. 

The plaintiffs filed a motion for injunction pending appeal on January 31, 2024. The motion requested that the court enjoin the defendants from preventing the plaintiffs’ use of campus facilities for their March 2024 drag show, or enforcing viewpoint- and content-discriminatory prohibitions on expressive activity contained in the president’s original March 2023 email against the 2023 drag show. The plaintiffs requested an expedited ruling by February 9, 2024.

The court declined to expedite consideration of the preliminary injunction motion on February 5, 2024, so the students filed a motion for an injunction pending appeal in the Fifth Circuit on February 9, 2024. The Fifth Circuit issued an order on February 22, 2024 stating that the motion for injunction pending appeal would be decided with the rest of the case. The plaintiffs subsequently asked the U.S. Supreme Court to issue an injunction pending appeal, but the Supreme Court declined to do so on March 15, 2024.

Oral argument occurred in the Fifth Circuit on April 29, 2024. As of December 2024, the Fifth Circuit has yet to issue a decision, and the district court has stayed the case to wait for an appellate decision.
