On October 4, 2012, parents residing in the State of California, licensed marriage and family therapists, clinical psychologists, the National Association for Research and Therapy of Homosexuality, and American Association of Christian Counselors brought this suit against the Governor of California, the Secretary of the State and Consumer Services Agency, an Executive Officer of the California Board of Behavioral Sciences, the President of the California Board of Psychology, and the President of the Medical Board of California.

SB 1172 was a bill that banned the practice of conversion therapy on minors in California or other treatments intended to eliminate or reduce same-sex attraction. In their suit, plaintiffs alleged that SB 1172 violated federal and state constitutional guarantees. Specifically, plaintiffs alleged (1) violation of mental health providers’ free speech rights under the First Amendment as SB 1172 mandates “viewpoint discrimination” and potentially subjects providers to professional discipline by declaring certain kinds of counseling impermissible; (2) violation of mental health providers’ right to liberty of speech under Article I, §2 of the California Constitution; (3) violation of the right to free exercise of religion for all plaintiffs under the First Amendment; (4) violation of the right to free exercise of religion for all plaintiffs under Article I, §4 of the California Constitution; and (5) violation of parental rights to direct the upbringing and education of one’s own children under the First and Fourteenth Amendments. Plaintiffs filed suit under 42 U.S.C. § 1983. 

Plaintiffs sought damages and injunctive and declaratory relief. Noting that SB 1172 was to go into full effect in January 2013, plaintiffs specifically also sought a preliminary injunction to enjoin defendants from enforcing the new law.

The case was assigned to Judge Kimberly J. Mueller.

On October 19, 2012, Equality California, a nonprofit civil rights organization and sponsor of SB 1172, filed a motion to intervene as a defendant.

In October 2012, plaintiffs filed an amended motion for preliminary injunction. Plaintiffs also filed motions with the court to have two of the named plaintiffs appointed guardians ad litem for their minor children; to proceed using a pseudonym for confidentiality; and for a protective order.

The court also received notice of a potentially related case in the same month: Donald Welch v. Edmund Brown, No. 2:12-2484. However, within the month, the court determined that relating the cases will not adequately “effect a savings of judicial effort” and therefore, declined to relate the cases at the time.

On November 21, 2012, the court granted the plaintiffs’ motion to be appointed guardians ad litem, finding that the jurisprudence held the appropriate choice for a child’s guardian ad litem is typically their parents, and that it did not find a conflict of interest present here to prevent that appointment. The court also granted the plaintiffs’ protective order and pseudonym requests.

On December 4, 2012, the court declined to grant plaintiffs preliminary injunction. The court noted that the motion for preliminary injunction was based solely on plaintiffs’ first (violation of therapists’ free speech rights) and fifth (violation of parental rights under the First and Fourteenth Amendment) claims. In large part, the court held plaintiffs did not adequately demonstrate likelihood of success on their claim that SB 1172 would subject mental health professionals to discipline for recommending sexual orientation change efforts, highlighting the state’s position that it bars treatment efforts only, not referrals to religious counselors, mentions of other literature, or such efforts. The court held that SB 1172 does not implicate fundamental rights, and therefore any restrictions it places on therapy must be evaluated under rational basis scrutiny, which the court held it would pass. The court also granted Equality California’s motion to intervene as a defendant.

Plaintiffs filed a notice of appeal to the Ninth Circuit on their motion for preliminary injunction, on the same day that the court made its decision (docket no. 12-17744). The parties jointly requested a stay of district court proceedings, pending resolution of that appeal. The district court granted the motion to stay.

On January 29, 2014, a three-circuit panel on the U.S. Court of Appeals for the 9th Circuit, made up of Chief Judge Alex Kozinski, Judge Susan P. Graber, and Judge Morgan Christen upheld the district court’s denial of the plaintiff’s preliminary injunction motion. In that decision, the panel reversed an order granting preliminary relief in Welch v. Brown, No. 2:12-2484, and affirmed the denial of preliminary injunction in this matter. The court reasoned that SB 1172 does not violate the free speech rights of mental health providers, and does not violate parents’ fundamental rights. Further, the court held that SB1172 does not regulate speech, but only regulates professional conduct; as such, the court held that rational basis scrutiny was the appropriate framework for analysis, and SB 1172 passed rational basis muster. The panel remanded the cases for further proceedings, consistent with its finding that SB 1172 would survive constitutional scrutiny. Plaintiffs attempted to further appeal to the U.S. Supreme Court, but the Supreme Court declined to grant review. In accordance with the Ninth Circuit panel’s findings, the district court lifted the motion to stay and ordered a status conference.

Defendants then filed a motion to dismiss the remaining claims, citing as persuasive authority Stormans, Inc. v. Wiesman, 794 F.3d 1064 and Welch v. Brown, Case No. 2:12-2484, both of which the 9th Circuit had recently decided. On September 16, 2015, the district court granted the motion to dismiss. The court found persuasive defendant’s argument that the Governor of California is entitled to immunity from plaintiff’s Eleventh Amendment claims, and so dismissed those claims relating to the Governor. The court also agreed that, per the 9th Circuit’s findings, the law survived rational basis scrutiny, and therefore dismissed plaintiff’s free exercise of religion claims without leave to amend. With respect to any “as-applied challenge” in plaintiffs’ claims, the court held that the plaintiffs did not allege a concrete plan for violation of SB 1172, did not describe with particularity how the statute would be enforced against them, nor did they experience a “genuine threat of imminent prosecution.” The court held that as plaintiffs did not amend their complaint since the enactment of SB 1172 to fill in these details, their as-applied claims are dismissed with leave to amend.

On October 28, 2015, plaintiffs filed an amended complaint, largely re-alleging the substance of their claims in the original complaint. Defendants filed a motion to dismiss, arguing that the claims suffered from the same deficiencies that defendants had earlier argued.

On August 9, 2016, the district court granted defendants’ motion to dismiss without leave to amend. The court granted the motion to dismiss claims as to the Governor of California, holding that there was insufficient direct connection between the Governor and the enforcement of SB 1172 as to pierce government official immunity. The court also granted the motion to dismiss the plaintiffs’ “as-applied” challenges, as plaintiffs provided no factual allegations (such as specific actions taken by defendants applying the law differently to plaintiffs from other classes of people) which would render SB 1172 unconstitutional. Finding that the plaintiffs had, in large part, re-provided broad allegations that were not sufficiently specific, the court held it appropriate to dismiss plaintiffs’ claims entirely. In doing so, the court did not grant additional leave to amend as the plaintiffs had not cured the deficiency in their amended complaint. The case was therefore dismissed.
