This case is about an alleged dilution of the Latino and Hispanic vote in Salem Keizer School District elections in Oregon.
On October 28, 2022, the Latino Business Alliance and two individuals commenced this action in the Circuit Court for the State of Oregon for Marion County and asserted that the system of “at large” voting in Salem Keizer School District inhibited or to impaired Hispanic and Latino voters’ ability to elect their preferred candidates and diluted Hispanic and Latino voting strength in violation of their federal right pursuant to Section 2 of the Voting Rights Act of 1965. The plaintiffs sued the Salem Keizer School District and the Oregon Secretary of State. Plaintiffs sought declaratory and injunctive relief, along with costs,
disbursements, and attorneys’ fees.
On March 10, 2023, the defendant filed a notice of removal in the United States District Court District of Oregon, Eugene Division. Originally, the case was not removeable to federal court because defendant Secretary of State did not consent to the removal. She was later dismissed from the state action, and the remaining defendant successfully removed the action to federal court on March 10, 2023. The case was assigned to Judge Ann L. Aiken.
On March 21, 2023, counsel for the defendant submitted a stipulated notice of dismissal detailing that the parties settled the lawsuit. The details of the settlement are unknown to the Clearinghouse at this time.
On March 22, 2023, the Court issued a judgment dismissing the case. The case is now closed.
