This case challenged Florida's requirement that voter registration applications bear an original handwritten ("wet") signature, unless the applicant has a digital signature on file with the Florida Department of Highway Safety and Motor Vehicles (DMV). Plaintiffs alleged that this requirement violates the Materiality Provision of the Civil Rights Act of 1964, which prohibits election officials from denying the right to vote based on errors or omissions on voting-related documents that are immaterial to the applicant's qualifications. The case was dismissed at the district court level and appealed to the U.S. Court of Appeals for the Eleventh Circuit.

Florida has required voters to "subscribe" an oath upon registering since at least 1868. In 2005, the Florida Legislature amended the Voter Registration Act to clarify that a voter registration application is "complete" only if it contains "[t]he original signature or a digital signature transmitted by the Department of Highway Safety and Motor Vehicles of the applicant." Florida officials interpreted "original signature" to mean a wet-ink signature handwritten directly onto the paper application. In 2015, the Legislature created an online voter registration portal that allows applicants with a valid Florida driver's license or identification card to register using the digital signature already on file with the DMV. The online system compares the applicant's name and date of birth against DMV records, and if the information matches, the application and digital signature are transmitted to the county supervisor of elections. However, Floridians without a Florida driver's license or identification card cannot use the online system or a digital signature. They must instead complete a printed application with an original wet-ink signature and deliver or mail it to their county supervisor of elections. If the applicant fails to provide a qualifying signature, the application is deemed incomplete and rejected, and the applicant is denied registration regardless of whether they are otherwise qualified to vote.

On March 16, 2023, Vote.org, the Florida Alliance for Retired Americans, and the Florida State Conference of Branches and Youth Units of the NAACP filed a Complaint for Declaratory and Injunctive Relief in the U.S. District Court for the Northern District of Florida, assigned to Judge Allen Winsor. The Complaint named as defendants the Florida Secretary of State (then Cord Byrd) in his official capacity and all 67 of Florida's Supervisors of Elections in their official capacities. Plaintiffs brought their claim under 52 U.S.C. § 10101(a)(2)(B) (the Materiality Provision) and 42 U.S.C. § 1983, seeking a declaration that the Wet Signature Requirement violates the Civil Rights Act and an injunction preventing its enforcement. Plaintiffs alleged that the form of an applicant's signature (whether wet-ink, electronic, digital, facsimile, or stamped) provides no insight whatsoever into whether the applicant meets Florida's qualifications to vote, which are limited to age, citizenship, residency, and adjudicated legal status. Since the type of signature is immaterial to voter qualifications, rejecting an application solely because it bears a non-wet signature violates the Materiality Provision.

Shortly after the initial complaint was filed, the Republican National Committee and the Republican Party of Pasco County moved to intervene as defendants under Federal Rule of Civil Procedure 24, and the district court granted the motion. Plaintiffs then amended their complaint on June 12, 2023, adding Disability Rights Florida (DRF) as a plaintiff and refining their allegations. DRF is designated under 29 U.S.C. § 794e as Florida's Protection and Advocacy agency to ensure full participation in the electoral process for individuals with disabilities. The Secretary of State, the intervenors, and a group of ten supervisors of elections all moved to dismiss the First Amended Complaint. The Republican National Committee and Republican Party of Pasco County filed their motion to dismiss on June 26, 2023. On July 10, 2023, the United States filed a Statement of Interest supporting plaintiffs' position on the scope and enforceability of the Materiality Provision.

On October 30, 2023, the district court granted the motions to dismiss. The court first concluded that the Florida NAACP had sufficiently alleged organizational standing based on a redressable injury, so it declined to address the other plaintiffs' standing. The court also declined to address whether plaintiffs had statutory standing to sue under the Civil Rights Act, noting that plaintiffs' cases "provide little support for their position that anyone can sue under the Materiality Provision so long as they claim injury from denial of someone else's right to vote." Instead, the court dismissed on the "more straightforward" ground that plaintiffs failed to state a claim. Specifically, the court concluded that plaintiffs failed to allege facts "plausibly showing that the wet-signature requirement is immaterial." The court rejected plaintiffs' premise that a copied, faxed, or otherwise non-original signature is equal in stature to an original wet signature, finding that "original signatures carry different weight than other 'signatures'" given their ubiquity throughout public life. The court determined that racial discrimination was not an element of pleading a Materiality Provision violation but did not reach the questions of whether the Materiality Provision displaces state law or whether the opportunity to cure defective signatures defeats a facial challenge. On November 8, 2023, the court entered final judgment dismissing the Amended Complaint as to all defendants. Plaintiffs timely appealed.

On January 25, 2024, plaintiffs filed their opening brief in the U.S. Court of Appeals for the Eleventh Circuit. Plaintiffs argued that the district court misapplied the Materiality Provision by asking whether a wet signature has some value to the state generally, rather than asking the correct question: whether the form of signature is material to determining voter qualifications. Plaintiffs emphasized that voter qualifications in Florida are limited to age, citizenship, residency, and legal status, and that the method by which an applicant signs a form provides no insight into any of those qualifications. Plaintiffs also argued that they had standing through organizational injury based on diversion of resources. Vote.org alleged it must devote resources to alternative voter registration efforts in Florida because the Wet Signature Requirement prohibits use of its e-signature web application. DRF asserted standing as Florida's designated Protection and Advocacy agency. 

On January 30, 2024, the United States Department of Justice, Civil Rights Division, filed a brief as amicus curiae supporting plaintiffs-appellants. The government argued that the Materiality Provision is enforceable by private parties through § 1983, that the provision's scope extends beyond racial discrimination, and that procedural requirements like wet signatures are not material to voter qualifications. The government further argued that a law that rejects voter registration applications violates the right to vote even if applicants can try again with a different signature, and that the requirement cannot be justified solely on grounds of fraud prevention or solemnity when the state accepts digital signatures from DMV registrants.

On May 15, 2024, the Florida Secretary of State filed an appellees' brief defending the district court's decision. The Secretary argued that the Federal Rules of Civil Procedure governed dismissal under Rule 12(b)(6), that plaintiffs failed to establish Article III standing, that plaintiffs lacked prudential standing to assert the rights of third parties, and that plaintiffs had no private right of action to enforce the Materiality Provision under § 1983, urging the Eleventh Circuit to revisit its prior holding in Schwier v. Cox. On the merits, the Secretary argued that a signature is inherently material because it verifies the applicant's identity, deters fraud, and promotes public confidence in elections. The Secretary further argued that Florida's choice to accept digital signatures only when verified through the DMV's identity-confirmation process, where applicants physically present themselves and sign in the presence of an authorized agent, was a reasonable distinction reflecting different levels of identity assurance. The Republican National Committee and Republican Party of Pasco County also filed an appellees' brief on the same date, advancing similar arguments and emphasizing that the Materiality Provision does not preempt state law requirements and that the signature requirement does not deny anyone the right to vote because applicants can still register by completing a paper application.

On June 5, 2024, plaintiffs filed their reply brief, reiterating that the proper inquiry under the Materiality Provision is whether the challenged requirement is material to determining voter qualifications (not whether it serves some other state interest) and requesting that the Eleventh Circuit reverse the district court's dismissal and remand for further proceedings. Oral arguments were held on May 8, 2025 with the final decision of the Court still pending.
