On July 29, 2022, FemHealth USA (also known as carefem), a nonprofit organization that provides reproductive and healthcare services, filed a complaint in the U.S. District Court for the Middle District of Tennessee against a group of defendants, including Operation Save America, the corporation’s members, as well as private residents of Tennessee. The plaintiffs alleged that the defendants violated the Freedom of Access to Clinic Entrances Act (“FACE Act”) by physically obstructing, intimidating, and interfering with individuals who sought to obtain reproductive health services through carefem’s clinic in Mt. Juliet, Tennessee. The complaint alleged that the defendants’ protest activities required plaintiffs to take patients to a secure location behind locked doors and call the police. As a result, carefem sought an emergency temporary restraining order such that the defendants would stop their behavior, along with compensatory damages, civil penalties against the defendants, and attorney’s fees. Carefem was represented by a private law firm. The case was assigned to District Judge William L. Campbell. 

On July 29, 2022, due to Judge Campbell’s unavailability, Chief Judge Kimberly Crenshaw granted the temporary restraining order until August 5, 2022. The order concluded that the defendants violated the FACE Act by physically obstructing patients’ and providers’ access to the entrance of carefem. The order, thus, prohibited the defendants from physically obstructing, intimidating, injuring or interfering with any person who is or has been obtaining or providing reproductive health services, or from entering the healthcare facility. 

On August 2,2022, the temporary restraining order was extended until August 12. On August 9, the plaintiffs filed a motion for a preliminary injunction to further restrain the defendants from physically obstructing, intimidating, and interfering with individuals obtaining or providing reproductive health services from carefem’s facility, including by way of sound amplification devices or by entering the facility. On August 12, the temporary restraining order was extended until September 9, 2022. 

On August 19, 2022, carefem filed an amended complaint seeking temporary or permanent injunctive relief, alleging not just a violation of the FACE Act, but also trespass, assault, and nuisance against the defendants. Defendants were also added to the case, namely At The Well Ministries, a corporation that is utilized to support protests at reproductive healthcare centers.

On September 9, the temporary restraining order was extended to September 14; then on that day, Judge Campbell granted the preliminary injunction. 2022 WL 4241269. Defendants appealed the order to the U.S. Sixth Circuit Court of Appeals on September 15 (docket: 22-5915), and a week later, on September 22, the OSA-specific defendants filed a motion to dismiss the amended complaint for failure to state a claim.

Defendants sought a stay of proceedings in the district court, pending resolution of their appeal, but the court denied that on November 9, 2022. Litigation proceeded on the motion to dismiss over the next months; the court denied dismissal on August 23, 2023. 2023 WL 5498055. 

Meanwhile, the appeal also continued to be litigated. The U.S. Department of Justice filed an amicus brief in support of carefem. On September 29, 2023, the Sixth Circuit dismissed it due to the factual and legal issues that had yet to be resolved at trial. 83 F.4th 551. 

Following numerous amendments to the case management order, on April 24, 2024, discovery was ordered due on June 24, 2024. Following the close of discovery, on August 26, 2024, carefem then filed a motion for summary judgment, as well a motion for default judgment against At The Well Ministries. In response, defendants filed a motion to dismiss on December 10, 2024. 

On January 13, 2025, Magistrate Judge Frensley filed a report and recommendation that carefem's motion for summary judgment be granted, and the defendants' motion to dismiss be denied as moot. On January 15, Chief Judge Campbell ordered that carefem file an additional memorandum in support of their motion for default judgment, noting that the amended complaint does not make clear that At the Well Ministries violated the FACE Act. The case remains ongoing.

TEMPORARY RESTRAINING ORDER: This case is before the Court on FemHealth USA, Inc., d/b/a carafem's Motion for an Emergency Temporary Restraining Order. (Doc. No. 2 ). Accordingly, Rickey Nelson Williams, Bevelyn Williams, Edmee Chavannes, Ja son Storms, Chester Gallagher, Matthew Brock, Coleman Boyd, Frank "Bo" Linam, Brent Buckley, AJ Hurley, and OSA, and their representatives, agents, employees, servants, attorneys and any and all others acting in concert or participati on with any of them, singularly or collectively, are hereby restrained, enjoined and prohibited from: (a) physically obstructing, intimidating, injuring or interfering with any person who is or has been obtaining or providing reproductive health se rvices at Providence Pavilion's facility at 5002 Crossings Circle, Mt. Juliet, Tennessee; and (b) entering onto the property of Providence Pavilion at 5002 Crossings Circle, Mt. Juliet, TN 37122 during carafems hours of operation Monday thro ugh Friday, 8:00 a.m. to 5:00 p.m. and Saturday 8:00 a.m. to 1:00 p.m. and during the time periods both two hours before and two hours after carafem's hours of operation. This Order is effective upon notice and service on the Defendants. The t erms of this Order shall be in effect until August 5, 2022.
