This is a case about access to the Federal Register in prison. The plaintiff, who was incarcerated in federal prison, filed this lawsuit on February 22, 2019, against the Federal Bureau of Prisons (“BOP”) in the U.S. District Court for the Southern District of Illinois. Though the plaintiff's initial complaint was about an unrelated issue, in a subsequent amended complaint (filed January 10, 2020) the plaintiff brought a claim under the Administrative Procedure Act against the US Attorney General and BOP officials. The plaintiff alleged that the BOP had violated his First, Fifth, and Fourteenth Amendment rights by denying him access to the Federal Register, and therefore preventing him from engaging in public comment on proposed rulemakings, including those of the BOP. The plaintiff, representing himself, sought a declaratory judgment, an injunction requiring BOP to make the Federal Register available in its prisons, and money damages. Judge Phil Gilbert presided. 

On April 23, 2020, the court dismissed the amended complaint upon preliminary review as frivolous and meritless. 2020 WL 1955283. Plaintiff appealed to the Seventh Circuit on May 28, 2020. The Seventh Circuit appointed counsel to assist Plaintiff with his appeal. On March 29, 2021, the Seventh Circuit vacated the District Court’s dismissal of the case and remanded it for further proceedings. 841 Fed.Appx. 1011. The Seventh Circuit held that the District Court erred by resolving a factual dispute—whether the BOP had provided Plaintiff access to its proposed rulemakings—in favor of Defendants. The District Court had also not properly addressed the broader issue of access to the Federal Register for other agencies' rulemakings. The case was remanded, though the District Court subsequently dismissed any individual claims for monetary damages. 2021 WL 2333764.

Back in the District Court, Plaintiff filed a series of motions requesting that the court appoint him counsel, but the district court denied these motions because he had not properly justified the need for appointed counsel. On November 10, 2022, Defendants filed a motion for summary judgment, arguing that Plaintiff had access to BOP's proposed rules and regulations via the inmate electronic bulletin board, and that not providing access to the broader Federal Register did not violate Plaintiff's rights.

On March 31, 2023, the District Court granted Defendants’ motion for summary judgment. 2023 WL 2743584. First, the court found that Plaintiff did have access to the BOP’s proposed regulatory rule changes. The court also found that Defendants were not acting arbitrarily and capriciously in failing to provide inmates with a complete copy of the entire Federal Register, and that Defendants’ decision not to provide complete copies of the Federal Register to inmates was rationally related to a legitimate penological interest of the institution. Finally, the court held that the First, Fifth and Fourteenth Amendments were not implicated in these claims. The court subsequently dismissed Plaintiff's complaint with prejudice and directed the Clerk to enter judgment in favor of Defendants. 

On April 17, 2023, Plaintiff appealed the grant of summary judgment and the District Court’s denial of his motions for recruitment of counsel. On June 30, 2024, the Seventh Circuit affirmed the final judgment, finding that the BOP’s policy was reasonably related to its legitimate penological interest and that the District Court did not abuse its discretion in denying the request for recruitment of counsel. 109 F.4th 975.

This case is now closed.

ORDER: Plaintiff has filed a Motion for Leave to Proceed In Forma Pauperis ("IFP") in this case (see Doc. 1 ), but has failed to provide the necessary prisoner trust fund account information as required by the PLRA to determine whether the inmate is entitled to proceed without prepaying fees and costs. ORDER DENYING 41 Post-Judgment Motion to Seal Case. This case is on appeal, which normally divests the district court of jurisdiction over those aspects of the case that are involved in the appeal. Griggs v. Provident Consumer Disc. Co., 459 U.S. 56, 58 (1982). The motion is unrelated to the pending appeal. In it, Plaintiff seeks an order sealing his underlying case, which was filed almost two years ago and has never been sealed. Documents filed in court are "presumptively open to the public." See Bond v. Utreros, 585 F.3d 1061, 1073 (7th Cir. 2009). A party cannot seal whatever documents he wants. See Citizens First Nat. Bank of Princeton v. Cincinnati Ins. Although an appeal of this matter is pending, the court may: (1) defer considering the motion; (2) deny the motion; or (3) state either that it would grant the motion if the court of appeals remands for that purpose or that the motion raises a substantial issue. ORDER GRANTING 76 Motion to Supplement (Substitute) Defendants. This case involves claims under the Administrative Procedures Act against Federal Bureau of Prisons officials, in their official capacities. Two of these defendants, J.E. Krueger (BOP North Regional Director) and B. Lammer (Warden of United States Penitentiary - Terre Haute), have been succeeded by Andrew Matevousian and Warden Rule, respectively. Plaintiff seeks to "supplement" - i.e., substitute - Matevousian and Rule in place of Krueger and Lammer, in their official capacities. Defendants do not object to this request, to the extent Plaintiff seeks "substitution" and not "addition" of these official capacity defendants under Fed. R. Civ. P. 25. (See Doc. 78). Rule 25 authorizes the Court to order substitution of an officer's successor at any time a public officer named as a party in his or her official capacity ceases to hold office while an action remains pending. See Fed. R. Civ. P. 25(d). Even if the Court does not issue an order, however, substitution under Rule 25(d) is automatic. Id. ORDER DENYING 80 Motion for Recruitment of Counsel without prejudice. See Pruitt v. Mote, 503 F.3d 647, 654 (7th Cir. 2007) (articulating factors court considers when evaluating motions for counsel). An indigent plaintiff seeking representation by court-recruited counsel must demonstrate: (a) reasonable efforts to locate counsel on his own; and (b) an inability to litigate the matter without representation. Plaintiff has not demonstrated sufficient efforts to find counsel. He allegedly "wrote" to seven attorneys who declined to represent him in this matter. Setting aside the fact that he also claims to lack access to writing instruments, paper, etc., Plaintiff does not provide copies of any correspondence, the names of attorneys or law firms he contacted, the dates of any contacts, or a summary of the services he requested, and responses he received. In the meantime, Plaintiff has demonstrated his ability to competently litigate this matter from start to finish, through an appeal, and on remand, despite being house in the CMU with law library access that is limited to once or twice per week. In fact, Plaintiff has shown that he is quite capable of litigating this matter pro se. If that changes, Plaintiff may renew his request for court-recruited counsel, by filing a new motion and attaching a summary or copies of correspondence with at least three attorneys or law firms who have received and denied his request for representation in this case. He has only received a response to one, and he anticipates transferring from FCI-Terre Haute soon.
