This case is about Title IX interpretation and guidance documents issued by the Biden administration.

On June 14, 2023, the state of Texas filed this lawsuit in the United States District Court for the Northern District of Texas, Fort Worth Division. Represented by the state’s attorney general office, Texas sued the United States Department of Education and its Secretary (collectively, “DOE”), the United States Department of Justice and the Attorney General (collectively, “DOJ”) under the Administrative Procedure Act (APA). Texas claimed that the DOE, in violation of APA, issued three documents (collectively, “2021 Guidance”):

  1. The Notice of Interpretation stating Title IX prohibits discrimination based on gender identity;
  2. The Dear Educator Letter announcing the defendant will enforce Title IX protections for LGBTQ+ students, and;
  3. The Fact Sheet providing examples of conduct that would be considered violations of Title IX under the interpretation provided in the Notice of Interpretation.

Texas argued that these issuances exceeded the DOE’s power granted by Title IX and that it did not go through the public notice and comment process before the issuances, which constitutes a violation of APA. Texas sought to vacate the 2021 Guidance, as well as preliminary and permanent injunction. 

On October 20, 2023, the Texas filed a motion for summary judgment, and on December 1, 2023, the Defendants filed a motion to dismiss.

Although the court granted Texas’s motion for summary judgment while denying the Defendants’ motion to dismiss on June 11, 2024. However, it vacated the judgment on August 5, after Texas filed a motion to correct and clarify the judgment; in the motion, Texas asked that the court not only invalidate the 2021 Guidance but also to prohibit the federal government from interpreting or enforcing Title IX to include sexual orientation or gender identity in any future action against Texas or its schools.

On August 5, 2024, the court re-granted Texas's motion for summary judgment while denying the Defendants’ motion to dismiss. The court ruled that the Defendants’ acts were unlawful because the Defendants’ did not go through the process required, and the defendant exceeded their authority under Title IX by interpreting Title IX to prohibit discrimination based on gender identity. The court vacated the 2021 Guidance and enjoined the Defendants’ from enforcing Title IX only against Texas and its schools. 

On October 3, 2024, the Defendants appealed to the Fifth Circuit.

On October 18, 2024, the court ordered to stay further proceedings in this case pending issuance of the mandate in case No. 24-30399, Louisiana v. EDUC, based on the unopposed joint stipulation filed by the defendant.

As of April 17, 2025, the case is ongoing.
