This case concerns access to medications for opioid use disorder (MOUD) for incarcerated individuals.

On July 7, 2023, the plaintiff, who had an imminent criminal sentencing scheduled, filed suit in the U.S. District Court for the Southern District of West Virginia against Wexford, the for-profit medical provider for all regional jails and state prisons in West Virginia, and the Commissioner of the West Virginia Division of Corrections and Rehabilitation (DCR). Represented by Mountain State Justice, the Action Lab at Northeastern University Law School, and private counsel, the plaintiff brought claims under the Americans with Disabilities Act (ADA) and Section 504 of the Rehabilitation Act, alleging that when he was previously incarcerated the defendants had denied the plaintiff his medications for opioid use disorder, which constituted a failure to reasonably accommodate his disability and discrimination on the basis of disability. He also brought a claim under 42 U.S.C. § 1983, arguing that the denial of MOUD constituted deliberate indifference to his medical needs, in violation of the Eighth and Fourteenth Amendments. The plaintiff sought declaratory and injunctive relief to ensure the defendants would provide him MOUD during his incarceration, as well as attorneys' fees. The case was originally assigned to Senior Judge John T. Copenhaver, Jr., but subsequently reassigned to Judge Irene C. Berger.

The plaintiff moved for a preliminary injunction on July 10, 2023. The court held a hearing the same day, during which the defendants agreed to provide MOUD to the plaintiff while he was incarcerated. Therefore, two months later, on September 9, the plaintiff filed an amended complaint in which he removed his claims for injunctive relief and sought monetary damages instead for the denial of MOUD during his earlier incarceration.

On Jan. 3, 2024, Judge Berger denied the defendants' motions to dismiss. Judge Berger found that while the plaintiff would carry the burden of proving that defendants deliberately refused to provide MOUD, the complaint contained sufficient factual allegations regarding the gravity of MOUD denial in general and the specifics of plaintiff's case involving forced withdrawal from suboxone. 2024 WL 38555.

On February 9, 2024, the plaintiff filed another motion for a preliminary injunction to give him access to MOUD. The court denied the motion as moot the following month, on March 14, because the parties had reached an agreement to resolve the issue.

The plaintiff and defendants all moved for summary judgment in April 2024. The court denied all the motions on June 13, 2024. First, the court held that Wexford's liability under § 1983 was in dispute because it was unclear if the company had a policy or custom of denying MOUD. Second, the court held that it was disputed whether the West Virginia DCR had violated the ADA or Rehabilitation Act because the denial of the plaintiff's MOUD could have been based on an individual medical determination, or a mistake made by his individual medical provider, rather than a DCR policy. The court also held that the ADA protected the plaintiff from discrimination based on opioid use disorder even if the plaintiff was using opioids at the time of the denial of treatment. 2024 WL 2978782.

On June 25, 2024, parties agreed to settle for undisclosed terms. On Aug 30, 2024, Judge Berger dismissed the case.
