This case concerns Ohio's HB 458, which prohibited any person not an election official or mail carrier from returning an absentee voter's ballot. 

On December 19, 2023 The League of Women Voters of Ohio, represented by the ACLU and private counsel, filed a lawsuit against the Ohio Secretary of State, the Attorney General of Ohio and the County Prosecutor of Cuyahoga County in the U.S. District Court for the Northern District of Ohio. Plaintiffs challenged the law under the Voting Rights Act (VRA) and Americans with Disabilities Act (ADA) and sought injunctive relief. HB 458 provided that, with narrow exceptions, anyone who assisted voters with returning their absentee ballots commits a felony. Plaintiffs alleged that these assistance restrictions placed a heavy burden on the ability of voters with disabilities to cast their ballots, as many require professional help to manage complex or severe disabilities. The case was assigned to Judge Bridget Meehan Brennan. 

On January 1, 2024 the Republican National Committee and the Ohio Republican Party moved to Intervene in the case to protect their "substantial interest" in supporting "Ohio's reasonable, neutral and effective election provisions." Their motion was granted on February 6, 2024. 

On May 24, 2024 several states and the District of Columbia filed an Amici Curiae brief in support of Plaintiffs’ Motion for Summary Judgment. In their brief they asserted that Ohio’s law is “out of step” with nearly all other state laws, and that their experience suggests that this “outlier law harms voters with disabilities and provides few benefits.”

On June 17, 2024, the United States filed a statement of interest, in which they argued that Ohio’s law violated the VRA as well as the ADA. 

On July 22, 2024, the court granted plaintiff's motion for partial summary judgment and issued a permanent injunction enjoining Ohio from administering, implementing or enforcing HB 458 against any individual who assists a disabled voter with the return of the disabled voter’s absentee ballot to the extent such enforcement contradicts Section 208 of the Voting Rights Act. The court found that §208 of the VRA preempted the Ohio State law because "[l]ooking simply at the text of the statute and applying the ordinary meaning of 'a’person of the voter’s choice,' Section 208 gives disabled voter’s the right to choose who will facilitate the submission of their absentee ballot without further restriction by the state." Because Ohio's law restricted a disabled voter's ability to choose who will facilitate the submission of their absentee ballot Ohio's law was in conflict, and therefore pre-empted, by the VRA. The court also found that Purcell did not bar the issuance of an injunction because the changes being made were relatively small and far enough away to not cause any confusion in the administration of the upcoming November 2024 election. Finally, because the court found there was ground for an injunction under the VRA it did not reach the ADA claims, dismissing them instead. The court also denied plaintiffs’ request for a broader injunction on ADA grounds. 

The case is ongoing.

Order [non-document]: Before the Court is the Unopposed Joint Motion of Plaintiffs, State Defendants, and Intervenors to Exceed Page Limit for Summary-Judgment Memoranda (Doc. No. 39 .) By agreement of the parties, this case received an expedited case designation. See Doc. Nos. 27 and 31 ; see also LR 16.2. For expedited cases, dispositive motions "must not exceed ten (10) pages," pursuant to LR 7.1(f). The motion seeks relief from this page limitation and specifically requests forty (40) pages for memoranda in support of summary judgment motions and opposition briefs. It does not seek to extend the page limit for reply briefs. The motion supports a finding that some relief from the ten (10) page limitation is merited, but it does not support a forty (40) page limit commensurate with mass tort cases. See LR 7.1(f) ("dispositive motions must not exceed... forty (40) pages for mass tort cases."). This case involves two plaintiffs, three named defendants, and two intervening parties. The named plaintiffs and intervening defendants appear aligned in their arguments and positions relative to the dispute at issue. LR 16.2(b)(2)(C). The factual and legal issues are "more than a few, some unsettled." LR 16.2(b)(2)(A). Thus, for briefing purposes, this case is more aligned with a standard track case. See LR 16.2(b)(2). Accordingly, the motion is GRANTED in part. The page limit for all memoranda in support of motions for summary judgment and all briefs in opposition is twenty (20) pages. IT IS SO ORDERED. Memorandum Opinion and Order: For the reasons stated herein, Plaintiffs' motion for partial summary judgment is GRANTED in part and DENIED in part. State Defendants' and Intervenors' motions for summary judgment are DENIED. C CPO's motion for summary judgment is DENIED. Plaintiffs' motion to exclude State Defendants' expert w itness is DENIED. Counts One, Two, and Four of the Complaint are DISMISSED without prejudice. Plaintiffs' request for declaratory and injunctive relief is GRANTED in part and DENIED in part. The Court finds that Section 208 of the Voting Right s Act, 52 U.S.C. § 10508, expressly allows a disabled voter to select a person of their choice to assist them with voting, including the return of a disabled voters absentee ballot. To the extent R.C. § 3599.21(A)(9) and R.C. § 3599.2 1(A)(10) prohibit such assistance by limiting who a disabled voter may select to assist them in voting absentee, the statutes are PREEMPTED by Section 208 of the Voting Rights Act. The State Defendants, the CCPO, and any of their agents, employees, or successors in office, are hereby PERMANENTLY ENJOINED from administering, implementing, or enforcing R.C. § 3599.21(A)(9) or R.C. § 3599.21(A)(10) against any disabled voter or against any individual who assists any disabled voter with the return of the disabled voter's absentee ballot to the extent such enforcement contradicts Section 208 of the Voting Rights Act, with immediate effect.
