This case is regarding Nassau County’s mask ban in public known as the Mask Transparency Act (MTA).

On August 22, 2024, two immunocompromised residents of Nassau County filed a lawsuit challenging the County’s ban on mask-wearing in public. In addition, they filed a motion for a preliminary injunction and a temporary restraining order arguing that the MTA would deny them equal access to community life and expose them to discrimination. The plaintiffs alleged that the MTA violated the United States Constitution Art. VI, cl. 2, the New York State Constitution, Art. IX § 2c, Title II of the Americans with Disabilities Act of 1990, and Section 504 of the Rehabilitation Act of 1973. The case was filed in the Eastern District of New York and assigned to Judge Joan M. Azrack and Magistrate Judge Steven I. Locke.

On August 23, 2024, the court granted the plaintiffs’ motion to proceed anonymously and use only their initials. On September 4, 2024, the defendants filed a memorandum in opposition to the plaintiffs’ request for preliminary injunction and a temporary restraining order. They argued that the plaintiffs lacked standing and that the interests of crime prevention and public health could both be served if the MTA was allowed to go into effect. On September 11, 2024, the plaintiffs filed their reply brief.

On September 25, 2024, the court dismissed the plaintiffs’ case without prejudice for lack of standing. The court agreed with the defendants that the plaintiffs would not suffer an injury because the law provides an exemption for individuals who wear masks for health and safety reasons. Further, the court found that the plaintiffs did not make a valid claim that law enforcement will misapply the MTA to them.
