This lawsuit is one of several challenging a US Department of Health and Human Services (HHS) rule interpreting the Affordable Care Act (ACA) as prohibiting discrimination based on gender identity. This lawsuit was filed on May 6, 2024, by the state of Florida, several state agencies, and the Catholic Medical Association. The plaintiffs sued HHS and various sub-departments under the Administrative Procedure Act (APA), alleging that the rule exceeded HHS's statutory authority and was arbitrary and capricious. They also alleged that HHS's interpretation of the ACA would cause the statute to violate the Constitution's Spending Clause by imposing conditions on federal funding without a clear statement. Finally, they alleged that the rule violated the First Amendment's free speech and free exercise protections, as well as the Religious Freedom Restoration Act. They sought a declaratory judgment, preliminary and permanent injunctions, and attorneys' fees.

The challenged HHS rule, promulgated in May 2024, interpreted the ACA's prohibition of discrimination "on the basis of sex" to include discrimination based on gender identity. According to HHS, this prevented covered entities from 1) denying health services based on gender identity or sex assigned at birth; 2) denying a health care professional's capacity to provide services if that denial constitutes discrimination based on gender identity or sex assigned at birth; 3) treating people differently based on sex in a way that causes more than de minimis harm; and 4) denying the provision of gender-affirming care based on a person's gender identity or sex assigned at birth. Here, the plaintiffs argued that HHS's rule contradicted the ACA and that "on the basis of sex" does not include gender identity, citing Adams v. School Board of St. John's County. Adams was a decision from the U.S. Court of Appeals for the Eleventh Circuit interpreting Title IX in the context of gendered bathrooms; the ACA's ban on discrimination incorporates the specific discrimination prohibition in Title IX. The plaintiffs also argued that, under Adams, gender-based distinctions like gender-assigned bathrooms are expressly permitted.

On May 7, 2024, the case was assigned to Judge William F. Jung and Magistrate Judge Thomas G. Wilson. On July 3, 2024, the court granted the plaintiffs' motion for a preliminary injunction and stayed the HHS rule as applied to Florida. The court found a substantial likelihood of success for plaintiffs on their APA claim based on Adams' holding that gender identity discrimination is not covered by Title IX's ban on sex discrimination. The court distinguished this case from Bostock v. Clayton County, which interpreted sex discrimination to include gender identity discrimination in the context of employment discrimination (Title VII), rather than health care. The court found also found potential for irreparable harm because without an injunction, Florida would have to change its policies or else lose federal funding. 2024 WL 3537510.

On August 30, 2024, HHS appealed the preliminary injunction to the Eleventh Circuit, and on September 11, the Catholic Medical Association filed a cross-appeal on the preliminary injunction with the Eleventh Circuit. The district court stayed its own proceedings to wait for the appeal. 

Before the Eleventh Circuit could rule, the parties voluntarily dismissed their appeals on March 14, 2025; the Eleventh Circuit granted the motion on April 3, 2025. A few days later, on April 9, the district court lifted the stay and closed the case. The case is now closed.
