This is a class action lawsuit alleging that the New York State Department of Corrections and Community Supervision (DOCCS) intentionally denied all people with moderate mental health disorders from having the opportunity to complete a program that would have made them eligible for early release. 

The plaintiff, a formerly incarcerated individual out on parole, filed a complaint on December 2, 2020 against the DOCCS, alleging that the plaintiff was forced to spend nine extra months in prison because he lacked access to the Shock Incarceration Program (Shock). Shock, a boot-camp-style program, provided six months of exercise, substance abuse treatment, education, pre-release counseling, and life skills counseling. Incarcerated individuals could become eligible via a judgement imposed by their sentencing court or by applying to the DOCCS selection committee. After his denial from Shock, the plaintiff was allegedly denied participation in the Comprehensive Alcohol and Substance Abuse Treatment (CASAT) program because of a physical disability. Represented by private counsel, the plaintiff filed suit pursuant to the Americans with Disabilities Act (ADA), 42 U.S.C. §§ 12111 et seq., and the Rehabilitation Act, 29 U.S.C. § 701. 

The plaintiff sought to certify a class of all persons who were (1) incarcerated in a New York state prison; (2) not judicially ordered to be enrolled in Shock; (3) disqualified from Shock on the basis that they were classified as mental health Level 1, 2, or 3; (4) otherwise eligible to enroll in Shock; and (5) not given an alternative six-month pathway to early release from prison. The plaintiff also sought compensatory damages and attorneys’ fees.

On Count 1, the plaintiff alleged a violation of the Rehabilitation Act because the defendant discriminated against the plaintiff, who is disabled, when it denied him participation in Shock. On Count 2, the plaintiff alleged a violation of Title II of the Americans with Disabilities Act (ADA) because the defendant discriminated against the plaintiff, who is disabled, when it denied him participation in Shock and did not provide a reasonable accommodation. On Count 3, the plaintiff alleged the defendant excluded the plaintiff from CASAT and denied him the benefits of the program because of his physical disability in violation of the Rehabilitation Act. On Count 4, the plaintiff alleged a violation of Title II of the ADA because the defendant excluded the plaintiff from CASAT and denied him the benefits of the program because of his physical disability. 

The case was assigned to Judge David N. Hurd in the Northern District of New York and later reassigned to Chief Judge Brenda K. Sannes . The case was also assigned to Magistrate Judge Christian F. Hummel and later reassigned to Magistrate Judge Paul J. Evangelista. 

On March 2, 2021, the defendant filed a motion to dismiss for failure to state a claim, which was shortly after denied as moot, because the plaintiff filed an amended complaint on March 15, 2021 adding details about the plaintiff’s PTSD and its impact on him during his time incarcerated.

On March 29, 2021, the defendant filed another motion to dismiss for failure to state a claim. The defendant argued that the court lacked jurisdiction over the plaintiff’s Fifth and Fourteenth Amendment claims because those claims were barred by sovereign immunity under the Eleventh Amendment. Second, the defendant claimed that the plaintiff had not adequately alleged that he was “disabled” within the meaning of the ADA or the Rehabilitation Act. Third, the defendant argued that even if the plaintiff’s claims survived, his attempt at class certification must be denied.

The court denied the motion to dismiss on May 20, 2021, because it found that the plaintiff did not make any Fifth and Fourteenth Amendment claims, so there were no claims to dismiss on the basis of sovereign immunity. The court found that the plaintiff plausibly alleged a disability within the meaning of the ADA or Rehabilitation Act because he suffered from a physical or mental impairment and that his major life activity was substantially limited by that impairment. Finally, the court found the defendant’s request to deny class certification was premature given the procedural posture of the case - there had been no motion for class certification filed yet.

On October 28, 2022, the plaintiff filed a motion to certify a liability-only class. Mirroring his request in the complaint, he requested a class composed of all persons who (1) were incarcerated in DOCCS custody; (2) were excluded from the Shock on the basis that they were designated OMH Level 3 at any time between December 2, 2017, and November 3, 2021; (3) were not judicially ordered to be enrolled in Shock by their sentencing court; (4) were statutorily eligible to enroll in Shock; and (5) were not offered an alternative six-month pathway to early release from prison. The court approved this class certification on May 1, 2023.

The plaintiff filed a motion requesting summary judgement on Counts 1 and  2 (the discrimination claims), on March 1, 2024. Further details of the motion were not available to the Clearinghouse. In response, on April 5, 2024, the defendants filed a cross-motion for partial summary judgement. The defendant alleged that any claims for money damages under the ADA were barred by sovereign immunity.

On October 3, 2024, the court granted the plaintiff’s request for summary judgement as to the discrimination claims and denied the defendant’s cross-motion for summary judgement. The court found the plaintiff showed that he was a qualified individual with a disability, the entity was subject to the ADA and Rehabilitation Act, and he was denied the benefit of the shock program because of his disability. 

The case was reassigned to Chief Judge Brenda K. Sannes on October 30, 2024.

As of March 2025, this case is ongoing.
