This lawsuit was filed in the Western District of New York against the New York Attorney General for allegedly chilling the free speech of crisis pregnancy centers. 

On April 22, 2024, the Attorney General of New York issued Notices of Intention to Sue to eleven faith-based, pro-life pregnancy centers for their speech about the use of abortion pill reversal (APR). She alleged that there was a lack of information about the effectiveness and safety of APR.

On May 24, 2024, the plaintiffs, two nonprofit pro-life pregnancy centers and one nonprofit network of affiliated centers, filed a complaint alleging the Attorney General was attempting to chill their speech about APR. Specifically, plaintiffs alleged that the defendant sought to “deprive women who change their mind and want to continue their pregnancies, or who are coerced or tricked into a chemical abortion, of truthful information about progesterone treatment, a safe option that has been used by obstetrician- gynecologists to help maintain pregnancies for decades.” They argued the defendant violated their first amendment right to freedom of speech, first amendment right to free exercise, first amendment right to religion, and fourteenth amendment right to due process by the defendant’s attempt to target, chill, and punish plaintiffs’ speech about progesterone treatment. The plaintiffs requested a declaratory judgment, and preliminary and permanent injunction that barred the defendant from enforcing New York General Business Law, Article 22-A, §§ 349 and 350 and Executive Law § 63(12) against the plaintiffs and their members. The case was assigned to District Judge John Leonard Sinatra Jr.

On July 29, 2024, the defendant filed her response in opposition to the plaintiffs’ motion for a preliminary injunction. They argued that the court lacked subject matter jurisdiction over the lawsuit, the plaintiffs have not suffered an injury, and that the plaintiffs did not the meet the burden for a preliminary injunction because the first amendment does not protect false or misleading speech. On August 22, 2024, the court granted the plaintiffs’ motion for preliminary injunction because they had standing, their claims were ripe for adjudication, and they were likely to succeed on the merits of their First Amendment Free Speech claim.

On August 26, 2024, the court consolidated this case Summit Life Outreach Center Inc. v. James (1:24-cv-00741) because both cases address the defendant’s alleged attempt to chill speech about APR.

On September 18, 2024, the defendant filed a notice of appeal to the U.S. Court of Appeals to the Second Circuit. On September 24, 2024, the court issued an order staying the proceedings for this case pending the appeal.

As of January 2025, this case is ongoing.
