PAPERLESS ORDER. THIS MATTER is before the Court sua sponte. On November 2, 2025, Plaintiffs filed a Motion for Clarification (DE 82 ), in which they ask this Court to clarify its class certification order (DE 63 ) and supplement the record with new evidence. Defendants' response is currently due on November 17, 2025. In an effort to potentially expedite the response and further develop the record for the Eleventh Circuit's consideration, it is ORDERED AND ADJUDGED that, by 12:00 P.M. on Friday, November 7, 2025, the Parties shall file a notice that provides the Court with three dates and times that the Parties are available for a Status Conference to (1) discuss the new evidence, (2) address any counter evidence that Defendants may wish to present, and (3) consider the Parties' arguments as to the Motion for Clarification (DE 82 ). Because a court may "amend class certification orders at any time prior to a decision on the merits," Prado-Steiman ex rel. Prado v. Bush, 221 F.3d 1266, 1273 (11th Cir. 2000) (emphasis in original), this Court will consider issuing a clarification order or amending the class certification order based on the Parties' arguments.
