This case concerns a challenge by a pregnancy resource center (also referred to as crisis-pregnancy centers) against the Governor of Massachusetts’ campaign to discourage people from seeking medical care at such centers.  On August 19, 2024, A Woman’s Concern filed suit against the Governor of Massachusetts, the Commissioner of the Massachusetts Department of Public Health, and the Reproductive Equity Now Foundation and Director. This case concerns a challenge by a pregnancy resource center (also referred to as crisis-pregnancy centers) against the Governor of Massachusetts’ campaign to discourage people from seeking medical care at such centers. 

On August 19, 2024, A Woman’s Concern filed suit against the Governor of Massachusetts, the Commissioner of the Massachusetts Department of Public Health, and the Reproductive Equity Now Foundation and Director. A Woman’s Concern  was represented by the Massachusetts Liberty Legal Center as well as the American Center for Law & Justice. A Woman’s Concern alleged that the Massachusetts state government has embarked on a “factually baseless advisory” campaign against their services, which has included baseless investigation actions and threats of enforcement proceedings. A Woman’s Concern asserted that the state’s actions constituted a violation of its First Amendment rights to free speech and free exercise of religion, as well as its Fourteenth Amendment right to equal protection. It filed suit in the U.S. District Court of Massachusetts, seeking declaratory and injunctive relief, as well as compensatory damages. The case was assigned to Judge Leo T. Sorokin.

This case is still ongoing.

District Judge Leo T. Sorokin: ELECTRONIC ORDER entered.At the hearing and in its Notice to the Court, Doc. No. 58, Plaintiff requests leave to amend its complaint in light of additional documents it recently received pursuant to the Massachusetts Public Records Act. At the conclusion of the hearing, the Court raised the possibility rather than now resolving the pending Motions, allowing Plaintiff to amend its Complaint, terminating as moot the Motions to Dismiss, and permitting Defendants to file new motions to dismiss either with new briefs or supported by their existing briefs (but not both) to challenge the Amended Complaint. Plaintiff's counsel assented to this process. Defendants requested the Court resolve the pending Motions, but otherwise did not object to the procedure proposed. After due reflection, the Court ALLOWS Plaintiff to file an Amended Complaint, terminates the pending Motions to Dismiss, Doc. Nos. 33, 42, as moot in light of the anticipated Amended Complaint and directs the parties to file within seven days a proposed schedule to govern the filing of the Amended Complaint and the anticipated motions to dismiss. The Court suggests that Plaintiff file one consolidated memo in opposition to the anticipated motions and similarly suggests that Defendants endeavor to coordinate their filings to avoid duplicative arguments.
