This lawsuit was filed on October 5, 2021, in the U.S. District Court for the Northern District of California. Plaintiffs, representative of the residents of Steamer Landing Park camp, filed an ex parte application for a temporary restraining order (TRO) and preliminary injunction. Plaintiffs requested that the court halt the expulsion of homeless persons from Steamer Landing Park by granting a TRO and preliminary injunction against the defendants' criminalization of homelessness pursuant to Petaluma Municipal Code 13.28.010 and the misapplication of Penal Code 602 (h) through (o) and Penal Code 647(e). Plaintiffs asserted a violation of their fourth, eighth and fourteenth amendment rights.

Plaintiffs sought to bar defendants from removing plaintiffs and all similarly situated persons, from Steamer Landing Park and other homeless encampments and essentially prohibiting them from camping anywhere in the City of Petaluma. The judge presiding over this case was Judge Edward M. Chen. On the day the lawsuit was filed, the court granted plaintiffs' ex parte application for a temporary restraining order, enjoining the city from closing the encampment at issue, evicting campers therefrom, seizing and disposing of their property, and/or arresting them for violating the anti-camping ordinance. This TRO was extended and then converted to a preliminary injunction. 

On December 15, 2021, plaintiffs filed an amended complaint, adding an organizational plaintiff. Additionally, plaintiffs modified their request for relief, seeking declaratory relief as well as injunctive relief. They also added claims against defendants, asserting a violation of the Americans with Disabilities Act (ADA) and the Fair Housing Act (FHA).

On January 21, 2022, defendants filed a motion to dismiss plaintiffs' first amended complaint. Defendants argued that the organizational plaintiff lacked standing, the claims against the Police Chief were deficient, the Petaluma Police Department was not a separate entity, the ADA violation allegation failed to state a cause of action, the Fair Housing Act allegation failed because plaintiffs did not state facts showing a violation, and the plaintiffs' fourth and fourteenth amendment claims related to seizure of property did not state a claim. 

On May 16, 2022, the court ordered the previously issued preliminary injunction, which prohibited the city from enforcing its anti-camping ordinance and/or removing the plaintiffs from the park, to be dissolved as of June 10, 2022. The court requested the defendants to provide a status report on its outreach efforts towards the residents, and they did so, describing their outreach, which included offering shelter and visiting the park almost daily. 

On June 6, 2022, plaintiffs filed a notice of voluntary dismissal of entire case without prejudice. The case is closed.
