This case involved a class action lawsuit on behalf of all people required to register under Michigan’s Sex Offender Registry Act (SORA). On August 30, 2016, the plaintiff filed this lawsuit on behalf of himself and similarly situated plaintiffs in the United States District Court for the Eastern District of Michigan Southern Division against the governor of Michigan and the director of the Michigan State Police under the due process clause of the Fourteenth Amendment. Represented by private counsel, the plaintiffs alleged that the registration requirement violated their due process rights of travel, work, and raising children, and that it violated the vagueness, strict liability, and impossibility doctrines under the due process clause. The plaintiffs sought class certification, injunctive relief, and attorneys’ fees. The case was assigned to Judge John Corbett O'Meara.

On September 23, 2016, the case was reassigned to Judge Robert H. Cleland.

On April 21, 2017, both parties moved the court to stay this proceeding until the Supreme Court resolved the petition for certiorari currently pending on Does v. Snyder, 834 F.3d 696 (6th Cir. 2016), petition for cert. filed December 14, 2016. The court granted the stay and issued an order closing the case for administrative purposes. 

On November 13, 2017, the court reopened the case. 

On June 28, 2018, the plaintiffs filed an amended complaint, adding that the Sixth Circuit Court of Appeals held that SORA imposes punishment and that retroactive application of SORA’s 2006 and 2011 amendments violates the U.S. Constitution’s Ex Post Facto Clause.

On September 11, 2018, the court granted plaintiff’s motion for class certification, finding a “primary class” defined as all people who are or will be subject to registration under Michigan’s Sex Offenders Registration Act, and two “ex post facto” sub-classes (the “pre-2006 ex post facto subclass” and the “2006-2011 ex post facto subclass.”

On May 23, 2019, the court issued a stipulated order for declaratory judgment, finding that the current Sex Offender Registration Act (SORA) was punishment and that the ex post facto application of the 2006 and 2011 amendments was unconstitutional. The court issued a 90 day deferral of a decision on injunctive relief to provide opportunity for legislative resolution.

On February 14th, 2020 the court granted plaintiff’s motions for injunctive and declaratory relief. Shortly after, due to the Covid-19 pandemic, on April 6th, 2020 the court issued an interim order delaying entry of its final judgment. 

On June 21, 2021, the court granted in part plaintiff’s motion for judgment and denied defendant’s motion to clarify judgment, finding that the possibility of future prosecutions for violations of the old SORA statute required the entry of a final judgment.

On August 4th, 2021, the court found for the plaintiffs. It granted the plaintiff’s motion for declaratory and injunctive relief and plaintiff’s motion for partial summary judgment.

On August 26th, 2021, the court issued an amended final judgment. It declared Michigan’s pre-2021 SORA unconstitutional for vagueness, lack of due process (strict liability), or First Amendment violations as applied retroactively to individuals whose offenses occurred before July 1, 2011 and held that SORA constituted punishment and its retroactive application violated the Ex Post Facto Clause. The court permanently enjoined enforcement of the old SORA against this group (the new SORA was not challenged) and ordered notice be sent to law enforcement and other parties.
