This is a case about gender equality in school sports. On June 29, 2021, a 13-year-old transgender girl filed this lawsuit in the United States District Court Southern District of Florida. This is a case about gender equality in school sports. On June 29, 2021, a 13-year-old transgender girl filed this lawsuit in the United States District Court Southern District of Florida. Represented by Human Rights Campaign Fund, the plaintiff sued Florida High School Athletic Association, Broward County School Board, and the Florida State Board of Education under the Equal Protection Clause and Substantive Due Process Clause, as well as Title IX of the Education Amendments of 1972, 20 U.S.C. § 1681, et seq. Tde plaintiff challenged SB 1028, titled “Fairness in Women’s Sports Act,” which mandates that participation in school-sponsored girls’ or women’s sports teams in public secondary schools and postsecondary institutions must be based on a student’s biological sex assigned at birth, as stated on an original birth certificate. The plaintiff sought injunctive relief, nominal damages, costs, expenses, and attorney’s fees. 

On August 23, 2021, the defendants filed a motion to dismiss. 

On September 21, 2021, a cisgender female student-athlete filed a motion to intervene. The motion was denied March 30, 2023 because she was no longer a student-athlete.

On January 31, 2022, the court denied the motion to dismiss. The Eleventh Circuit had an en banc oral argument scheduled for the next month in Adams v. The School Board of St. Johns County, Florida, a case challenging a school district's policy of sex-separated bathrooms for public school students under the Equal Protection Clause and Title IX. The court in this case reasoned that the Eleventh Circuit’s decision might materially affect the results in this case. Accordingly, in addition to denying the motion to dismiss, the court stayed the case and administratively closed it pending the Eleventh Circuit’s ruling. 

On January 6, 2023, the case was reopened, and the defendants filed a renewed motion to dismiss with prejudice on February 10, 2023.On November 6, 2023, the court granted the defendant’s motion to dismiss. The court reasoned that (1) SB 1028 did not violate Title IX because it allowed separation based on biological sex, (2) SB 1028 did not violate the Equal Protection Clause because the governmental interest of promoting equal athletic opportunities for females is important, and SB 1028 was substantially related to that interest as there are physiological differences between males and females, and (3) SB 1028 did not violate Substantive Due Process (right to privacy) because it did not require disclosure of private information.

However, the court allowed the plaintiff to amend their claim, and the plaintiff filed the first amended and supplemental complaint on January 11, 2024. In the amended complaint, the plaintiff strengthened the Equal Protection claim, adding more details on the issue of discriminatory animus.

On February 14, 2024, the defendant filed a motion to dismiss the amended complaint, which was granted on December 19, 2024. The court, considering factors such as disparate impact, foreseeability, historical background, legislative process, and availability of alternatives, rejected the view that SB 1028 was enacted with invidious discriminatory intent against transgender girls. In the same order the court dismissed the case.
