This is a case about the U.S. Citizenship and Immigration Services reversal of a 30-year policy and practice which would have denied the lawful permanent residency applications for otherwise previously eligible applicants.

On November 8, 2021, a group of noncitizen immigrants residing in the United States under the Temporary Protected Status (TPS) category filed a class action complaint in the United States District Court for the Southern District of New York. The suit was filed against U.S. Citizenship and Immigration Services (USCIS) and the Department of Homeland Security (DHS). The plaintiffs seek class certification, declaratory and injunctive relief, and attorney’s fees under the Immigration and Nationality Act (INA), 8 U.S.C. § 1255(a), and the Administrative Procedure Act (APA), 5 U.S.C. § 706(2). The plaintiffs asked the court to grant an injunction for the defendants to immediately cease applying their policy, declare the policy arbitrary and capricious, and order the defendants to recognize them and similarly situated persons as having meet the statutory requirements for their lawful permanent residency applications. The plaintiffs were represented by the National Immigration Litigation Alliance. The case was assigned to Judge Andrew Carter.

The case arose after USCIS abruptly reversed its policy concerning noncitizen immigrants in the United States under TPS. TPS is a program created by Congress which grants noncitizen immigrants the ability to stay in the United States if their home country is designated a country where a disaster, conflict, or other qualifying condition took place. Individuals qualifying for TPS are permitted to travel abroad with permission of USCIS, and their return to the United States was considered an inspection, admission, or parole into the United States as required for an application for lawful permanent residency. This was the defendants’ policy for nearly 30 years until its internal Administrative Appeals Office (AAO) issued a decision in an individual case, Matter of Z-R-Z-C-, which adopted as its agency-wide position. In August 2020, the agency reversed its position and declared it a “legal fiction” to say that these individuals’ return to the United States was considered an inspection, admission, or parole into the United States. Thus, previously eligible TPS individuals were now no longer eligible to apply for lawful permanent residency.

On March 2, 2022, the defendants filed a motion to dismiss on the grounds that judicial review under the APA was only available for final actions, a lack of standing, and that the matter was unripe thus the court lacked subject matter jurisdiction. The defendants argued that because Z-R-Z-C- was still ongoing, it did not represent a final agency action that is subject to judicial review. They also claimed that because the plaintiffs’ claims have not been adjudicated, they had not suffered the requisite harm to have standing. Finally, the defendants contended the matter was unripe because the agency was continuing its decision- making process.

Before the court ruled on the defendants' motion to dismiss, it entered an order granting a joint motion to say the proceedings on July 20, 2022. The parties move to stay because the defendants issued a policy memorandum on July 1 which rescinded its designation of Z-R-Z-C- as an Adopted Decision and effectively mooted the plaintiffs’ claims.

The suit was voluntarily dismissed on November 15, 2022.
