Under the E-Government Act of 2002, any agency “initiating a new collection of information that (I) will be collected, maintained, or disseminated using information technology; and (II) includes any information in an identifiable form permitting the physical or online contacting of a specific individual” is required to complete a Privacy Impact Assessment (“PIA”) before initiating such collection. See 44 U.S.C. § 3501 note. In this case, Jane Doe 1 and 2, who work for the federal government, argue that the Trump Administration has created a new centralized system to email federal employees without complying with the statute. They filed a complaint against the Office of Personnel Management under the Administrative Procedure Act. Represented by National Security Counselors and a private law firm, plaintiffs sought declaratory and injunctive relief as well as attorney fees. They filed the case in the U.S. District Court for the District of Columbia on January 27, 2025, requesting an injunction on behalf of the class of similarly situated individuals. On February 7, 2025, the plaintiffs, in an amended complaint, added Jane Doe 3 through 7 as plaintiffs.

On February 4, 2025, the plaintiffs sought a temporary restraining order (TRO) arguing that the new centralized system was insecure and placed the plaintiffs' private information as well as the information of other similarly situated federal workers in danger. The plaintiffs additionally asserted that the deadline of February 6, 2025, for switching systems, was completely arbitrary. The court denied the motion at at a hearing held Feb. 6, but allowed plaintiffs to refile, which they did the next day. On February 11, 2025, the defendant filed a motion to dismiss, arguing that the plaintiffs lack standing.  A hearing on the refiled TRO was held on Feb. 13, 2025; decision is pending.
