The Executive Order sets out that (effective 30 days after the Executive Order), United States citizenship does not automatically extend to people born in the U.S. (1) when that person’s mother was unlawfully present in the United States and the father was not a United States citizen or lawful permanent resident at the time of said person’s birth, or (2) when that person’s mother’s presence in the United States at the time of said person’s birth was lawful but temporary and the father was not a United States citizen or lawful permanent resident at the time of said person’s birth.

On January 30, 2025, the plaintiff in this case, the County of Santa Clara, filed this lawsuit in the U.S. District Court for the Northern District of California against defendants President Trump and officials from the U.S. Department of Justice, the U.S. Department of State, the U.S. Department of Homeland Security, the U.S. Citizenship and Immigration Services, the U.S. Department of Health & Human Services, the Centers for Medicare & Medicaid Services, the Social Security Administration, the U.S. Department of Housing and Urban Development, and the U.S. Department of Agriculture. 

The County challenged the Executive Order under the Fourteenth Amendment to the U.S. Constitution and under 8 U.S.C. § 1401(a) which states that every “person born in the United States, and subject to the jurisdiction thereof,” “shall be nationals and citizens of the United States at birth.” The County alleged that the Executive Order violated the constitutional separation of powers, the Immigration and Nationality Act, and the Administrative Procedure Act. The County sought declaratory relief that the Executive Order was unconstitutional and unlawful. The County also sought a temporary restraining order, preliminary injunction, and permanent injunction barring the defendants from implementing or enforcing the Executive Order. The case was assigned to Judge Eumi K Lee. 

In several of the other cases, courts immediately granted temporary restraining orders against operation of the Executive Order. In this one, on February 5, 2025, the County of Santa Clara filed a motion for a preliminary injunction prohibiting the defendants from implementing or enforcing the Executive Order.

On Feb. 21, Judge Lee issued an order to show cause in light of developments in Washington v. Trump, a case in which the Western District of Washington issued an injunction that barred the federal government from enforcing the Executive Order challenged in this case. The defendants appealed that injunction, and on February 19, 2025, the Ninth Circuit Court of Appeals denied their emergency motion for a partial stay of that injunction. Because the injunction from the Washington case remains in effect while the appeal is pending (oral arguments will be heard in June 2025), Judge Lee asked the parties in this case to submit briefing to explain why this case should not be stayed pending the outcome of Washington. The court also vacated the preliminary injunction hearing, which had been scheduled for Feb. 27, 2025.

On March 18, Judge Lee stayed this case pending the developments in Washington v. Trump and New Jersey v. Trump, in which the Ninth Circuit and the First Circuit, respectively, will consider the government's appeals of preliminary injunctions in cases challenging EO 14160.
