This case is about a challenge to a South Carolina state budget provisio that allegedly limit instruction regarding racial and gender inequalities and oppression. 

On January 27, 2025, the South Carolina State Conference of the NAACP, author Ibram X. Kendi, a South Carolina school teacher, librarian and several students (collectively, “Plaintiffs”) filed a lawsuit challenging a state budget proviso titled "SDE: Partisanship Curriculum” in the United States District Court for the District of South Carolina. Plaintiffs sued the South Carolina Superintendent and two school districts.

Plaintiffs alleged that the budget provisio was discriminatory censorship in violation of the First and Fourteenth Amendments. Specifically, plaintiffs alleged that, through the enactment of the budget provisio, South Carolina legislators sought to limit instruction, training and resources regarding racial and gender inequalities and oppression. Plaintiff Kendi’s book “Stamped: Racism, Antiracism, and You” (“Stamped”) was removed from South Carolina school libraries in at least one school district as a result of the budget provisio. A plaintiff school teacher was required to modify her original lesson plan on argumentative essay writing about systemic racism. Other named plaintiffs include a school librarian advised to remove access to certain books, as well as high school students in South Carolina who had planned to take AP African American Studies before graduating — but attended schools that retracted the course following the enactment of the budget provisio.

Further, plaintiffs asserted that the South Carolina legislators discriminated against Black South Carolinians when enacting this legislation, as the legislators selectively enforced the proviso to prohibit educational engagement related to racial oppression, slavery, White supremacy, unconscious bias and systemic racism. Moreover, in enforcement, the budget provisio has been used to temporarily remove books by Black authors; limited lesson plans that tackle topics such as systemic racism; and led to the cancellation of AP African American Studies and other courses related to Black identity and culture across the state.

As a result, the plaintiffs claim the budget provisio infringes on their constitutional rights. The complaint alleged that the statute violates the First Amendment right to receive information and constitutes viewpoint discrimination. Further, the plaintiffs alleged that the budget provisio is unconstitutionally vague in violation of due process. Finally, the complaint asserted an equal protection claim based on the act’s discriminatory intent and effect on Black South Carolinians. Represented by the NAACP Legal Defense and Education Fund, Inc., as well as private counsel, Plaintiffs sought declaratory and injunctive relief. 

On March 4, one of the defendant school districts filed a motion to dismiss for failure to state a claim. Shortly after, on March 17, Plaintiffs filed a motion for preliminary injunction and then, on March 30, the second defendant school district filed a motion to dismiss under Fed. R. Civ. P 12(b)(1) and 12(b)(6). 

Plaintiffs filed an amended complaint on March 25. On April 1, the court denied the defendant school districts’ motions to dismiss as moot due to the filing of the amended complaint. 

As of April 1, 2025, the case is ongoing.

TEXT ORDER re 83 Motion for Leave to File Amicus Curiae. Decisions about whether and how to allow amicus participation in federal district court are left to the discretion of the trial judge. Md. Restorative Just. Initiative v. Hogan, No. ELH-16-1021, 2017 WL 467731, at *8 (D. Md. Feb. 3, 2017). Courts have allowed amicus briefs at the trial level when the briefs provide helpful legal analysis, when the proposed amici have a special interest in the subject matter of the suit, or when the existing parties would benefit from additional assistance. Bryant v. Better Bus. Bureau of Greater Md., Inc., 923 F. Supp. 720, 728 (D. Md. 1996). The court finds the proposed amicus briefing helpful to the resolution of the pending motions. [ECF Nos. 30, 49, 51.] Although amicus briefs are typically filed shortly after the principal brief of the supported party, Fed. R. App. P. 29(a)(6), the briefing here addresses, among other concerns, recent developments in First Amendment right-to-receive information claims not available when the principal motions were filed. Compare ECF No. 49. (filed April 21, 2025) with Little v. Llano Cnty., 138 F.4th 834 (5th Cir. 2025) (filed May 23, 2025); Mahmoud v. Taylor, 145 S. Ct. 2332 (2025) (filed June 27, 2025). Further, the attorneys general enumerated in the briefing have identified a special interest in the outcome of this litigation. See ECF No. 83 at 23.
